Informe jurídico sobre la Sentencia N.° 979/2021 (Sentencia de inconstitucionalidad contra la Ley N.° 31131)

Abstract
El presente informe pretende analizar los principales problemas jurídicos que se
evidencian en la Sentencia N.º 979/2021, en la cual el Tribunal Constitucional analiza los
presuntos vicios de inconstitucionalidad que se observan en la Ley N.º 31131 -Ley que
establece disposiciones para erradicar la discriminación en los regímenes laborales del
sector público, los cuales son alegados por el Poder Ejecutivo-. Ahora bien, la
controversia principal de la sentencia recae en la inconstitucionalidad de la Ley N.º
31131, la cual dispone incorporar a los servidores públicos que se encuentran bajo el
Régimen especial de Contratación Administrativa de Servicios a los regímenes regulados
por el Decreto Legislativo N.º 728 y el Decreto Legislativo N.º 276. Así, del referido
informe se concluye que el Régimen CAS es un régimen distorsionado y discriminatorio
que dificulta la unificación que pretende realizar Servir y, al brindar carácter
indeterminado al Régimen CAS, impide el acceso a la función pública y a la meritocracia
en los servidores públicos.
This report aims to analyze the main legal problems that are evidenced in Judgment No. 979/2021, in which the Constitutional Court analyzes the alleged vices of unconstitutionality that are observed in Law No. 31131 -Law that establishes provisions for eradicate discrimination in labor regimes in the public sector, which are claimed by the Executive Branch. Thus, the main controversy of the sentence falls on the unconstitutionality of Law No. 31131, which provides for the incorporation of public servants who are under the Special Regime for Administrative Contracting of Services to the regimes regulated by Legislative Decree No. 728 and Legislative Decree No. 276. Hence, the aforementioned report concludes that the CAS Regime is a distorted and discriminatory regime that hinders the unification that Servir intends to develop and, by making the CAS Regime indeterminate, prevents access to public function and meritocracy in public servants.
