Abstract
A partir del análisis de la sentencia que resuelve el recurso de anulación de laudo interpuesto
por ENEL GENERACIÓN PERÚ S.A.A. contra EMPRESA DE ELECTRICIDAD DEL
PERÚ S.A., emitida el 27 de abril de 2021 por la Segunda Sala Comercial de Lima en el
expediente N° 583-2019, el presente informe analiza tres problemas jurídicos vinculados con
el principio de congruencia en el arbitraje. En primer lugar, el autor se detiene en la exigibilidad
y fuentes del principio de congruencia en sede arbitral. Como segundo punto, se presenta un
análisis funcional de la congruencia; en particular, se destaca su importancia para definir el
alcance del litigio y el marco sobre el cual las partes ejercerán su defensa. Finalmente, el
informe evalúa si existió o no alguna vulneración del principio de congruencia y del derecho a
la defensa en el laudo arbitral cuya validez fue confirmada en sede judicial.
Based on the analysis of the sentence that resolves the recourse against arbitral award set by ENEL GENERACIÓN PERÚ S.A.A. against EMPRESA DE ELECTRICIDAD DEL PERÚ S.A., issued on April 27, 2021 by the Second Civil Chamber specialized in Commercial Matters of the Superior Court of Justice of Lima in Case No. 583-2019, this report analyzes three legal problems related to arbitral due process. In the first place, the author dwells on the enforceability and sources of the principle of congruence in arbitration. As a second point, a functional analysis of congruence is presented; In particular, its importance is highlighted to define the scope of the litigation and the framework within which the parties will act their defense. Finally, the report assesses whether or not the arbitral due process has been respected, in contrast to what was resolved about the arbitral award’s validity.
