Los efectos de la denuncia del Convenio CIADI sobre la posibilidad de iniciar arbitrajes de inversiones bajo tratado: un esfuerzo interpretativo de los artículos 71 y 72 del Convenio

Resumen
El objetivo principal de esta investigación consiste en realizar un esfuerzo interpretativo de los
artículos 71 y 72 del Convenio CIADI, de acuerdo con lo dispuesto por las reglas de
interpretación de los tratados, con miras a determinar los efectos de la denuncia de dicho
Convenio sobre la posibilidad de iniciar arbitrajes de inversiones bajo tratado. Para alcanzar
este objetivo, a lo largo de la investigación se recurre a herramientas del método dogmático,
del método exegético y del método histórico, así como también se analiza en detalle lo
dispuesto por la jurisprudencia.
A la fecha de la presentación de esta investigación, existen tres posiciones que han sido
acogidas por la doctrina y la jurisprudencia con respecto al tema materia de análisis. Tras
estudiar lo dispuesto por cada una de ellas, y luego de interpretar los artículos 71 y 72 del
Convenio CIADI, se confirma la hipótesis principal de esta investigación que plantea que los
inversionistas aún podrían perfeccionar el consentimiento, o aceptar las ofertas de arbitraje
CIADI del Estado denunciante del Convenio, incluidas en los tratados que ya hayan entrado
en vigor antes de la fecha de recibo de la notificación de la denuncia por el depositario, en
tanto que dichos tratados no terminen o que el Estado Contratante que denunció el Convenio
no se retire de ellos, en caso de que se trate de tratados multilaterales.
The main objective of this investigation is to make an interpretative effort of articles 71 and 72 of the ICSID Convention, in accordance with the rules of interpretation of treaties, with the purpose of determining the effects of the denunciation of said Convention on the possibility of initiating investment arbitrations under treaties. In order to achieve this objective, throughout the investigation, the tools of the dogmatic method, the exegetical method and the historical method are used, as well as a detailed analysis of case law. As of the date of the presentation of this investigation, there are three positions that have been adopted by the doctrine and case law with respect to the subject matter of analysis. After studying the provisions of each one of them, and after interpreting articles 71 and 72 of the ICSID Convention, the main hypothesis of this investigation is confirmed, which states that investors could still perfect consent, or accept the ICSID Convention offers of the State denouncing the Convention, included in the treaties that have already entered into force before the date of receipt of the notification of denunciation by the depositary, as long as such treaties do not terminate or the Contracting State that denounced the Convention does not withdraw from them, in the case of multilateral treaties.
