Gestión de calidad de la justicia laboral: resultados de su implementación en la Corte Superior de Justicia de Lima Norte en el año 2019

Abstract
Considerando que el trabajo decente tiene estrecha correlación con el
desempeño de la judicatura laboral, en este trabajo de investigación se evalúa los
resultados de la aplicación, en la Corte Superior de Justicia de Lima Norte, del sistema
de gestión de calidad para procesos laborales electrónicos basado en la Norma ISO
9001:2015; investigación que se circunscribe al año 2019. La pregunta principal que
guía la investigación es la siguiente: ¿Cuál es la incidencia de la adopción de un sistema
de gestión de calidad en función de la Norma ISO 9001:2015 en la Sala Laboral
Permanente de Independencia de la Corte Superior de Justicia de Lima Norte sobre los
estándares de calidad de la justicia en el año 2019?. Su objetivo general consiste en
demostrar la utilidad de dicho sistema sobre la base del examen de una muestra
representativa de los procesos laborales, regulados por la Ley 29497, a la luz de los
estándares de justicia comúnmente aceptados. El punto de partida es la hipótesis en
torno a que la adopción del sistema de gestión de calidad citado fue útil en el período
analizado para el logro de la tutela judicial efectiva en las relaciones de trabajo, siendo
la conclusión principal que la aplicación de dicho sistema permitió la reducción de la
duración de los procesos en segunda instancia, resultando necesaria la incorporación
al sistema de otros estándares de justicia. Se logró asimismo reconstruir
argumentativamente el deber de la judicatura de adoptar un sistema de gestión de
calidad como principio institucional implícito del sistema secundario.
Considering that decent work is closely correlated with the performance of the labor judiciary, this research evaluates the results of the application, in the Superior Court of Justice of Lima Norte, of the quality management system for electronic labor processes based on in ISO 9001:2015; research that is limited to the year 2019. The main question that guides the research is the following: What is the incidence of the adoption of a quality management system based on the ISO 9001: 2015 Standard in the Permanent Labor Chamber of Independence of the Superior Court of Justice of Lima Norte on the quality standards of justice in the year 2019?. Its general objective is to demonstrate the usefulness of said system based on the examination of a representative sample of labor processes, regulated by Law 29497, in light of commonly accepted standards of justice. The starting point is the hypothesis that the adoption of the aforementioned quality management system was useful in the period analyzed for the achievement of effective judicial protection in labor relations, the main conclusion being that the application of said system allowed the reduction of the duration of the second instance processes, making it necessary to incorporate other justice standards into the system. It was also possible to argumentatively reconstruct the duty of the judiciary to adopt a quality management system as an implicit institutional principle of the secondary system.
