Informe Jurídico sobre la Resolución N°2948-2019- SUNARP-TR-L

Abstract

El presente informe jurídico analiza la Resolución N° 2948-2019-SUNARP-TR-L, emitida el 15 de noviembre de 2019, por el Tribunal Registral. En esta resolución, el Tribunal Registral realiza una calificación registral de fondo o completa sobre un título contenido en un acto administrativo referente a la independización de un predio rústico sin cambio de uso. La calificación realizada por el Tribunal Registral deniega la inscripción del acto administrativo, fundamentada en su contravención a una normativa legal expresa. Además, el Tribunal Registral procede a inaplicar los criterios establecidos por el XCIII Pleno Registral en relación a la calificación de actos administrativos. Este informe aborda las limitaciones existentes en la calificación registral de actos administrativos, centrándose particularmente en los casos de independización de predios rústicos sin cambio de uso y en la presunción de legalidad y validez que caracterizan a los actos administrativos.

This legal report analyzes Resolution No. 2948-2019-SUNARP-TR-L, issued on November 15, 2019, by the Registry Court. In this resolution, the Registry Court conducts a substantive or comprehensive registry qualification of a title contained in an administrative act concerning the subdivision (independización) of a rural property without a change of land use. The qualification carried out by the Registry Court denies the registration of the administrative act, based on its contravention of an express legal provision. Furthermore, the Registry Court disregards the criteria established by the XCIII Registry Plenary regarding the qualification of administrative acts. This report addresses the existing limitations on the registry qualification of administrative acts, focusing particularly on cases involving the subdivision of rural properties without a change of land use and the presumption of legality and validity that characterizes administrative acts.
