Abstract
El presente trabaja tiene como finalidad evaluar si el grupo económico conformado por Ferrocarril Transandino S.A. (FETRANSA), Perurail S.A. (PERURAIL), Peruval Corp S.A. (PERUVAL) y Peruvian Trains & Railways S.A. (PTR) incurrieron en el abuso de la posición de dominio sobre el mercado de transporte de personas en las vías de la Concesión del Ferrocarril del Sur- Oriente, mediante el abuso de procesos y procedimientos. De acuerdo a la Sala de Defensa de la Competencia, las denunciadas no habrían cometido esta falta debido a que todos los procesos tenían como finalidad la defensa de un derecho que consideraban propio. Por tanto, en el presente trabajo se argumentará si el desarrollo que realizaron en esta resolución, refleja apropiadamente las instituciones de derecho extranjero que fueron usadas para determinar la responsabilidad de las denunciadas.
The purpose of this paper is to assess whether the economic group formed by Ferrocarril Transandino S.A. (FETRANSA), Perurail S.A. (PERURAIL), Peruval Corp S.A. (PERUVAL) and Peruvian Trains & Railways S.A. (PTR) incurred in the abuse of a dominant position over the passenger transport market, on the tracks of the Concession of the Southern-Eastern Railway, through the abuse of processes and procedures. According to the Camara de Defensa de la Competencia, the defendants would not have breached any antitrust provition because all the processes had as their purpose the defense of a right that they considered their own. Therefore, in this paper it will be argued whether the development they made in this resolution appropriately reflects the institutions of foreign law that were used to determine the responsibility of the defendants.
