Resumen
La presente tesis tiene como objetivo analizar el cumplimiento del estándar de debida diligencia
reforzada en los protocolos institucionales de la Policía Nacional del Perú y el Ministerio Público sobre
desapariciones de mujeres. Ello debido a que, el propósito es garantizar el derecho de las mujeres a una
vida libre de violencia y su acceso efectivo a la justicia, así como asegurar que el Estado cumpla con su
obligación de proteger los derechos humanos mediante investigaciones con la debida diligencia
reforzada. Para ello, se identifican los siete elementos de este estándar desarrollados por la Corte
Interamericana de Derechos Humanos en las sentencias Campo Algodonero vs. México, Veliz Franco
vs. Guatemala y Velásquez Paiz vs. Guatemala, las cuales abordan las desapariciones de mujeres y la
negligencia estatal. A partir de este marco, se analizan los protocolos, concluyendo que su cumplimiento
con este estándar es parcial. Estas deficiencias encontradas afectan gravemente la recepción de
denuncias y la realización de investigaciones oportunas, que deben ser inmediatas para evitar que las
desapariciones deriven en feminicidios. Esta falta de acción configura una responsabilidad estatal, al
convertir al Estado en cómplice de la violencia y de la impunidad que continúan afectando a las mujeres.
The objective of this thesis is to analyze compliance with the standard of enhanced due diligence in the institutional protocols of the Peruvian National Police and the Attorney General’s Office on the disappearance of women. The purpose of this analysis is to guarantee women's right to a life free from violence and ensure their effective access to justice, as well as to ensure that the State fulfills its obligation to protect human rights through investigations conducted with enhanced due diligence. To this end, the seven elements of this standard developed by the Inter-American Court of Human Rights in the judgments González “Cotton Field” vs. México, Veliz Franco vs. Guatemala, and Velásquez Paiz vs. Guatemala are identified. These cases address the disappearance of women and State negligence. Based on this framework, the protocols are analyzed, concluding that their compliance with this standard is partial. The deficiencies identified severely impact the reception of complaints and the timely conduct of investigations, which must begin immediately to prevent disappearances from resulting in femicides. This lack of action constitutes State responsibility, making the State complicit in the violence and impunity that continue to affect women.
