Informe Jurídico sobre la Resolución N.°0144-2021/SBN- DGPE, respecto de la reversión parcial de predio estatal transferido a la Municipalidad Distrital de Villa María del Triunfo por incumplimiento de la finalidad

Resumen
El presente informe tiene como objetivo el análisis jurídico de la Resolución N.° 0144-2021/SBN- DGPE, mediante el cual se declara infundado el recurso de apelación interpuesto por la empresa MB Ingenieros S.A.C ante la resolución emitida por la Subdirección de Administración del Patrimonio Estatal de revertir un predio estatal otorgado a la Municipalidad Distrital de Villa María del Triunfo. La controversia involucra la presunta desnaturalización de la finalidad del predio transferido originalmente para un complejo deportivo, que terminó destinado mayoritariamente al desarrollo comercial, a través de la construcción del centro comercial Real Plaza.
Este caso reviste especial relevancia por el conflicto entre la administración eficiente del patrimonio estatal, los principios del Derecho Administrativo y los derechos adquiridos mediante contratos de concesión. Asimismo, se examinan los deberes de supervisión de la SBN, la validez del procedimiento seguido y el respeto a los derechos y principios que rigen la administración pública, en especial la omisión de notificación a una de las partes involucradas. El análisis permite cuestionar si la medida adoptada fue proporcional al objetivo perseguido y si se resguardaron adecuadamente los principios de legalidad, razonabilidad y seguridad jurídica.
The purpose of this report is the legal analysis of Resolution No. 0144-2021/SBN-DGPE, which declares unfounded the appeal filed by MB Ingenieros S.A.C against the decision issued by the Subdirección de Administración del Patrimonio Estatal to revert a state-owned property granted to the District Municipality of Villa María del Triunfo. The controversy involves the alleged distortion of the purpose of the land originally transferred for a sports complex, which ended up being used mainly for commercial development, through the construction of the Real Plaza shopping centre. This case is particularly relevant because of the conflict between the efficient administration of state assets, the principles of administrative law and the rights acquired through concession contracts. It also examines the SBN's supervisory duties, the validity of the procedure followed and the respect for the rights and principles governing public administration, in particular the omission to notify one of the parties involved. The analysis allows us to question whether the measure adopted was proportional to the objective pursued and whether the principles of legality, reasonableness and legal certainty were adequately safeguarded.
