Empleabilidad e inclusión laboral de las personas trans: promover medidas para la inserción en el trabajo en igualdad de condiciones y libre de discriminación

Abstract
El presente trabajo de investigación expone la problemática que existe para las personas trans su
empleabilidad e inserción laboral, cuyo objetivo general es exponer la discriminación de la que son
víctimas por su identidad y expresión de género lo cual perpetúa la marginación a la que son
sometidos en los diferentes espacios de su vida y limita o hasta evita que logren desarrollar un
proyecto de vida en dignidad.
Asimismo, se evidencia que el derecho del trabajo es una herramienta que nos permite utilizar sus
principios y características, las mismas que al emanar en un espacio tan importante como el
laboral; puede reivindicar los derechos de este colectivo y permitirles el real disfrute y gozo de
todos sus derechos fundamentales en este espacio.
A su vez, se plantea una solución en miras de buscar la inserción de las personas trans en el
empleo decente desde condiciones de igualdad, así como establecer medidas que permitan una
real erradicación de la discriminación múltiple hacia este grupo vulnerable, tomando como partida
las herramientas que nos brinda el Sistema de Inspección Laboral a cargo de Sunafil.
This research work exposes the problems that exist for trans persons in their employability and labor insertion, which general objective is to expose the discrimination that they are victims due to their gender identity and expression, that perpetuates the marginalization to which they are subjected in the different spaces of their life and limits them from being able to develop a life project in dignity. Likewise, is evidenced that labor law is a tool that allows us to use its principles and characteristics, which emanates in a space as important as working places; can vindicate the rights of this group and allow them the real enjoyment of all their fundamental rights. At the same time, a solution is proposed in order to seek the insertion of trans persons in decent employment under conditions of equality, as well as to establish measures that allow a real eradication of multiple discrimination towards this vulnerable group, taking as a starting point the tools provided by the Labor Inspection System in charge of Sunafil.
