Abstract
El presente informe jurídico analizará la interpretación, realizada por la Sala
Especializada de Protección al Consumidor del Indecopi, del cumplimiento del
deber de idoneidad de las entidades financieras respecto a la adopción de
medidas de seguridad para autorizar operaciones no reconocidas en los
productos financieros de una persona vulnerable-un adulto mayor de 86 años.
De este modo, inicialmente, se abordarán los conceptos y el análisis del deber
de idoneidad y las garantías aplicables a la prestación de servicios.
Seguidamente, se analizarán la adopción de medidas de seguridad y el patrón
de consumos del denunciante, de acuerdo con los artículos 19° y 20° de la Ley
N°29571, Código de Protección y Defensa del Consumidor. Finalmente, se
planteará una crítica respecto a la protección que la normativa les otorga a los
adultos mayores en el sistema financiero y la falta de incentivos de los
proveedores financieros de ofrecer un servicio adecuado a los mismos.
This legal report analyzes the interpretation made by the Specializad Chamber for Consumer Protection of Indecopi about duty of financial institutions regarding the adoption of security measures to authorize unrecognized operations in the financial products of an elderly and vulnerable person. First, the concepts and the analysis of the duty of suitable services will be addressed. Then, the adoption of security measures and the consumption pattern will be analyzed, in accordance with articles 19° and 20° of Law N°29571, Consumer Protection and Defense Code. Finally, a criticism will be raised regarding the protection the consumer regulations grant to the elders in the financial system, and the lack of incentives from financial institutions to offer an adequate service to them.
