Abstract
El objetivo del presente informe se orienta a analizar si el Tribunal del Servicio Civil, a
través de la Resolución No. 1162-2021-SERVIR/TSC-Segunda Sala, sancionó de manera
adecuada la comisión de actos de hostigamiento sexual que se configuraron en el presente
caso. De este modo, el análisis se ha realizado a partir del estudio de los elementos que
conforman el hostigamiento sexual y sus manifestaciones, un análisis de los fundamentos
desarrollados por el Tribunal del Servicio Civil respecto a los criterios de graduación
determinados por las autoridades del Procedimiento Administrativo Disciplinario, así como
el análisis de los criterios de razonabilidad que nos permitirán verificar si nos encontramos
ante una sanción razonable y, por ende, proporcional a la falta cometida.
De este modo, a partir de los fundamentos contenidos en el presente informe, se concluyó
que el Tribunal del Servicio Civil no realizó un adecuado análisis, pues no impuso una
sanción proporcional a la falta cometida, toda vez que, existiendo elementos que permitían
intensificar la falta, el Tribunal hizo caso omiso a ello y decidió ratificar la sanción de
suspensión temporal por ciento ochenta (180) días.
En ese sentido, teniendo en cuenta que el Colegiado no realizó un análisis adecuado, se ha
señalado qué otras consideraciones debieron apreciarse, a fin de imponer una sanción
adecuada que, en este caso, es la destitución. Además, se propone un cuadro ponderativo
que puede servir como una guía para identificar qué sanción corresponde imponer ante la
configuración de un acto de hostigamiento sexual.
The purpose of this paper is to analyze whether the Civil Service Tribunal, through Resolution No. 1162-2021-SERVIR/TSC-Second Chamber, adequately sanctioned the commission of acts of sexual harassment that occurred in this case. The analysis is based on the study of the elements that make up sexual harassment and its manifestations, an analysis of the grounds developed by the Civil Service Tribunal with respect to the graduation criteria determined by the authorities of the Administrative Disciplinary Procedure, as well as the analysis of the reasonableness criteria that will allow us to verify whether we are faced with a reasonable sanction and, therefore, proportional to the offense committed. Therefore, it was concluded that the Civil Service Tribunal did not carry out an adequate analysis since it did not impose a sanction proportional to the conduct committed, since there were elements that allowed the Tribunal to intensify the misconduct and it decided to ratify the sanction of temporary suspension for one hundred and eighty (180) days. In this sense, considering that the Collegiate did not carry out an adequate analysis, it has been pointed out that other considerations should have been taken into consideration in order to impose an adequate sanction, which in this case is dismissal. In addition, a weighting table is proposed that may serve as a guide to identify the appropriate sanction to impose when an act of sexual harassment has been committed.
