Resumen
Este informe tiene por objetivo examinar la Resolución N° 131-2010-OS/CD a la luz
de los principios que rigen el procedimiento administrativo sancionador: legalidad,
tipicidad, Non bis in ídem y razonabilidad. Para ello, se parte del análisis de los hechos
acontecidos en el año 2007, confrontándolos con la evolución normativa vigente hasta
el año 2025.
El procedimiento en cuestión presenta particularidades notables. Fue iniciado por el
OSINERGMIN poco después de que se le confirieran competencias en materia
minera-ambiental, en un contexto en el que su marco sectorial aplicable aún se
encontraba en una etapa inicial. Asimismo, la Ley del Procedimiento Administrativo
General había sido promulgada hacía pocos años y era vista todavía como una norma
de carácter supletorio, más que como una legislación marco. Este análisis busca
ofrecer una visión retrospectiva con el fin de evaluar críticamente la situación actual.
A partir de este examen, se concluye que, si bien el OSINERGMIN estaba habilitado
para ejercer funciones de supervisión y sanción, las deficiencias del marco normativo
y la falta de cumplimiento de los principios del debido procedimiento sancionador
dieron lugar a una decisión administrativa que a pesar haber agotado la vía
administrativa, bien podría ser considerada nula de pleno derecho por vulnerar
principios esenciales del ordenamiento jurídico.
This report aims to examine Resolution No. 131-2010-OS/CD in light of the principles governing the administrative sanctioning procedure: legality, typification, Non bis in ídem, and reasonableness. To that end, it begins with an analysis of the events that occurred in 2007, comparing them with the regulatory developments in force as of 2025. The procedure in question presents notable particularities. It was initiated by OSINERGMIN shortly after it was granted authority over environmental matters in the mining sector, at a time when the applicable sectoral framework was still in its early stages. Moreover, the General Administrative Procedure Law had only recently been enacted and was still regarded more as a supplementary rule than a comprehensive regulatory framework. This analysis aims to provide a retrospective perspective in order to critically assess the current situation. Based on this examination, it is concluded that, although OSINERGMIN was authorized to exercise supervisory and sanctioning powers, shortcomings in the regulatory framework and the failure to observe the principles of due administrative procedure led to an administrative decision that, despite exhausting the administrative process, could rightfully be considered null and void for violating fundamental principles of the legal system.
