Informe jurídico sobre la validez y eficacia de la Resolución Suprema N° 019-2014-EM en relación con la ampliación de concesión otorgada a Empresa Regional de Servicio Público de Electricidad del Norte S.A. en la zona de Pampas de Olmos

Resumen
El presente informe jurídico analiza el conflicto generado por la superposición de
concesiones de distribución eléctrica en la zona de Pampas de Olmos, donde
coinciden los intereses de dos empresas: ENSA, una empresa estatal, y
COELVISAC, una empresa privada. En este caso intervienen además el MINEM
y el GORE Lambayeque, cada uno actuando en procedimientos distintos.
Así, mientras ENSA tramitó ante el MINEM la ampliación de su concesión original
para incorporar Pampas de Olmos, COELVISAC hizo lo propio ante el GORE
Lambayeque con la finalidad de obtener una concesión de distribución eléctrica
sobre Tierras Nuevas que estaba yuxtapuesta con la Zona Pampa de Olmos,
generando una evidente superposición.
Este informe se centra en analizar la RS N° 019-2014-EM, mediante la cual el
MINEM aprobó la ampliación solicitada por ENSA, consolidando su derecho
exclusivo como único concesionario en dicha zona. Para ello, se aborda la
competencia del MINEM para otorgar ampliaciones de concesión eléctrica, el
procedimiento seguido por ENSA conforme al artículo 30 de la LCE, así como la
validez y eficacia de la RS expedida. De igual forma, se analiza el carácter tardío
e irregular de la actuación de COELVISAC, que refuerza la necesidad de
garantizar la continuidad del servicio eléctrico bajo el principio de subsidiariedad,
dado el rol de ENSA como empresa estatal encargada de asegurar el acceso
universal a la electricidad en Pampas de Olmos.
Todo ello para concluir que la RS sí es un acto administrativo valido y eficaz; por
lo que, la ampliación de concesión de distribución eléctrico se otorgó conforme
a ley.
This legal report analyzes the conflict arising from the overlap of electric distribution concessions in the Pampas de Olmos area, where the interests of two companies coincide: ENSA, a state-owned enterprise, and COELVISAC, a private company. In this case, the MINEM (Ministry of Energy and Mines) and the GORE Lambayeque (Regional Government of Lambayeque) also intervene, each acting within separate administrative procedures. Thus, while ENSA processed before MINEM the expansion of its original concession to incorporate Pampas de Olmos, COELVISAC did the same before GORE Lambayeque, seeking to obtain a distribution concession over “Tierras Nuevas,” which overlapped with the Pampas de Olmos area, thereby generating a clear superposition. This report focuses on analyzing Supreme Resolution No. 019-2014-EM, through which MINEM approved the expansion requested by ENSA, consolidating its exclusive right as the sole concessionaire in that area. To this end, it addresses MINEM’s competence to grant expansions of electric distribution concessions, the procedure followed by ENSA under Article 30 of the LCE, as well as the validity and effectiveness of the issued Supreme Resolution. Likewise, it examines the late and irregular actions of COELVISAC, which further underscore the need to ensure the continuity of the electric service under the principle of subsidiarity, given ENSA’s role as a state-owned company responsible for securing universal access to electricity in Pampas de Olmos. All of this leads to the conclusion that the Supreme Resolution is indeed a valid and effective administrative act; therefore, the expansion of the electric distribution concession was granted in accordance with the law.
