Resumen
En el presente caso, se condena al gerente de la empresa Corporación Industrial
Wash S.A.C., Agustín Leonardo Vásquez Nepo, por la comisión de un atentado
contra las condiciones de trabajo y salud en el trabajo, sentencia que contiene
aspectos jurídicos muy importantes de ser analizados. Uno de los más
resaltantes en el caso involucra la responsabilidad penal del gerente por la
omisión de medidas de seguridad laboral que resultaron en la muerte del
trabajador Elmer Santos Tocto. Por tanto, el presente informe pretende evaluar
el análisis dado a la conducta del señor Agustín Leonardo Vásquez Nepo. Para
ello, se emplearán herramientas como normas, artículos, doctrina y
jurisprudencia.
El objetivo principal es determinar si la imputación por el delito de atentado a las
condiciones de salud y seguridad en el trabajo a Agustín Leonardo Vásquez
Nepo resulta correcta. Para ello, se utilizará la teoría de la imputación objetiva
para probar que la conducta del gerente general resulta objetivamente típica.
Asimismo, se evaluará la responsabilidad atribuida a Agustin Vásquez Nepo bajo
la figura de la omisión y en virtud de la existencia de un deber de garante.
Además, se plantea la posible responsabilidad penal de la persona jurídica, ya
que las empresas pueden asumir responsabilidad por los delitos cometidos por
su alta dirección. Finalmente, se plantea si la implementación de un sistema de
compliance adecuado podría haber reducido el riesgo y evitado la
responsabilidad penal ante el delito tipificado en el artículo 168-A.
In the present case, the manager of Corporación Industrial Wash S.A.C., Agustín Leonardo Vásquez Nepo, has been convicted for committing an offense against workplace conditions and occupational health and safety. This judgment includes critical legal aspects that merit in-depth analysis. One of the most prominent issues in this case involves the criminal liability of the manager due to his failure to implement workplace safety measures, which resulted in the death of worker Elmer Santos Tocto. Consequently, this report aims to assess the analysis of Mr. Agustín Leonardo Vásquez Nepo's conduct. To achieve this, various tools will be employed, including legal norms, articles, doctrinal perspectives, and case law. The main objective is to determine whether the attribution of the offense concerning occupational health and safety conditions to Agustín Leonardo Vásquez Nepo is appropriate. To this end, the theory of objective imputation will be applied to demonstrate that the general manager's conduct is objectively unlawful. Furthermore, the attribution of criminal liability to Vásquez Nepo will be examined under the framework of omission, based on the existence of a guarantor’s duty. Additionally, the potential criminal liability of the legal entity itself will be explored, given that companies can be held accountable for crimes committed by their executives. Finally, it will be analyzed whether the implementation of an adequate compliance system could have mitigated the risk and prevented criminal liability for the offense defined in Article 168-A.
