Abstract
El presente trabajo de investigación busca analizar, entender, comprender e
interpretar la ley penal en blanco y su relación con el delito de minería ilegal. El
método empleado en la presente investigación es el del análisis de documentos, de
manera específica la doctrina y jurisprudencia respecto al tema de investigación.
Las principales conclusiones del delito de minería ilegal, previsto en el artículo 307°
A del Código Penal son: el primer párrafo del delito de minería ilegal es una norma
de accesoriedad administrativa de acto, la cual te remite a un acto administrativo
para establecer su complementariedad; descartando la posibilidad de la existencia
de una ley penal en blanco en este punto; el segundo párrafo del delito de minería
ilegal, tampoco es una ley penal en blanco, ya que cuando se hace referencia al
estar fuera del proceso de formalización no requiere de una norma extrapenal para
determinar el carácter delictuoso del acto, tampoco necesita de un acto
administrativo para estar fuera o dentro del proceso de formalización, pues la sola
presentación de la declaración de compromiso genera que el imputado se
encuentre dentro del proceso y por ende su conducta es atípica; la tercera parte del
tipo penal prescribe los delitos culposos de difícil realización. Finalmente, el delito
de minería ilegal, previsto en el artículo 307° A, no vulnera el principio de legalidad,
ya que el mandato de determinación (Lex certa) es claro.
The present research work seeks to analyze, understand, understand and interpret the blank criminal law and its relationship with the crime of illegal mining.
