Abstract

El presente informe jurídico realiza un análisis de la normativa ambiental vigente en temas de identificación de factores que sirvan para la determinación de responsabilidad ambiental en temas de remediación, además de abordar los Estándares de Calidad de Suelo con una visión al futuro y la necesidad de mayor normativa relacionada al cuidado medio ambiental del suelo. Todo esto gracias al análisis de la Resolución Nº 125-2019- OEFA/TFA-ST PIM, que resuelve la apelación presentada por Pluspetrol Norte S.A. por la imputación de no remediar el daño ambiental ocasionado dentro del Lote 8, donde ellos poseen un contrato de concesión.This legal report makes an analysis of the current environmental regulations on issues of identification of factors that serve for the determination of environmental liability in remediation issues, in addition to addressing the Soil Quality Standards with a view to the future and the need for further regulations related to environmental care of the soil. All this thanks to the analysis of Resolution No. 125-2019-OEFA/TFA-ST PIM, which resolves the appeal filed by Pluspetrol Norte S.A. for the charge of not remediating the environmental damage caused within Lot 8, where they have a concession contract.
