Resumen
El presente informe jurídico estudia la Resolución Nº0148-2023/SPC-INDECOPI,
mediante la cual se revocó la decisión de la Comisión de la Oficina Regional del
Indecopi, declarando así responsable a Scotiabank S.A. por infracción a los
deberes de idoneidad e información en perjuicio de Transportes Anfenasy
S.A.C., en el contexto del servicio financiero de transferencia interbancaria. El
problema jurídico central gira en torno a si Scotiabank S.A. puede ser
considerado objetivamente responsable de infringir los deberes de idoneidad e
información, teniendo en cuenta la totalidad de los hechos que se enmarcan en
el particular caso. Así también, determinar si Scotiabank S.A. actuó de
conformidad a la normativa sectorial y a la de protección al consumidor.
En lo extenso del informe, se concluye que la Sala de Protección al Consumidor
aplica un criterio cuestionable respecto a la interpretación de los deberes de
idoneidad e información en el contexto de las transferencias interbancarias. Esto
porque no toma en cuenta otros factores normativos como la garantía explícita
que comprende el Código de Protección y Defensa del Consumidor, o de
cumplimiento como el realizado por Scotiabank S.A. hacia la normativa sectorial
que lo regula.
De esta manera, este informe jurídico propone que no corresponde establecer
responsabilidad administrativa por parte de Scotiabank. Porque, se sostiene un
criterio inclinado hacia una interpretación objetiva de los deberes de idoneidad e
información, con comprensión de la normativa sectorial y la de protección al
consumidor, considerando además cuestiones particulares que la Sala no
aborda en lo extenso de la Resolución Nº0148-2023/SPC-INDECOPI.
This legal report analyzes Resolution No. 0148-2023/SPC-INDECOPI, by which the decision issued by the Commission of the Regional Office of Indecopi was revoked, declaring Scotiabank S.A. responsible for violating the duties of suitability and information, to the detriment of Transportes Anfenasy S.A.C., in the context of the financial service of interbank transfer. The central legal issue concerns whether Scotiabank S.A. can be held objectively responsible for infringing the duties of suitability and information, taking into account all the facts specific to the case. Likewise, it aims to determine whether Scotiabank S.A. acted in accordance with both sectoral regulations and consumer protection rules. Throughout the report, it is concluded that the Consumer Protection Chamber adopts a questionable approach regarding the interpretation of the duties of suitability and information in the context of interbank transfers. This is due to its failure to consider other regulatory elements, such as the explicit guarantees contemplated in the Consumer Protection and Defense Code, or Scotiabank S.A.’s compliance with the applicable sectoral regulations. Accordingly, this legal report proposes that Scotiabank should not be held administratively liable. This is based on a position that favors an objective interpretation of the duties of suitability and information, grounded in both sectorspecific and consumer protection regulations, while also considering particular aspects of the case that the Chamber fails to address in Resolution No. 0148- 2023/SPC-INDECOPI.
