Resumen
El presente informe jurídico analiza la Casación Laboral N° 7358-2013-Cusco, que estableció un criterio controvertido sobre la tramitación de demandas de reposición fundamentadas en desnaturalización contractual mediante el proceso abreviado laboral. El caso involucra a Magda Patricia Huamán Rivas, trabajadora del Poder Judicial contratada mediante contratos de servicio específico entre 2004-2011, quien demandó su reposición alegando que sus contratos temporales se habían desnaturalizado por realizar funciones permanentes como Asistente Judicial. La Corte Suprema, por mayoría, validó que la desnaturalización contractual puede analizarse en vía abreviada al considerarla un hecho jurídico integrante de la causa petendi y no una pretensión autónoma. Sin embargo, el análisis crítico desarrollado demuestra que este criterio vulnera principios procesales fundamentales como el debido proceso, la legalidad procesal y el derecho de defensa. La investigación emplea instrumentos normativos como la Nueva Ley Procesal del Trabajo (Ley N° 29497), el Decreto Supremo N° 003-97-TR, y jurisprudencia constitucional relevante. Se concluye que la determinación de modalidad contractual por desnaturalización requiere análisis probatorio complejo incompatible con la sumariedad del proceso abreviado, debiendo tramitarse por la vía ordinaria laboral para garantizar tutela jurisdiccional efectiva y respeto pleno a las garantías procesales constitucionales.
This legal report analyzes Labor Cassation No. 7358-2013-Cusco, which established a controversial criterion regarding the processing of reinstatement claims based on contract denaturalization through abbreviated labor proceedings. The research employs normative instruments such as the New Labor Procedural Law (Law No. 29497), Supreme Decree No. 003-97-TR, and relevant constitutional jurisprudence. It concludes that the determination of contractual modality through denaturalization requires complex evidentiary analysis incompatible with the summary nature of abbreviated proceedings, and should be processed through ordinary labor proceedings to guarantee effective jurisdictional protection and full respect for constitutional procedural guarantees.
