Abstract
El presente informe jurídico tiene por finalidad efectuar un análisis crítico de lo
resuelto por la Corte Suprema en la Casación Laboral N° 10273-2020-Lima, que
versó sobre la la correcta aplicación del artículo 57° del Decreto Supremo N°
001-97-TR, T.U.O. del Decreto Legislativo N° 650, la Ley de Compensación por
Tiempo de Servicios, para determinar si correspondía que la suma otorgada al
cese del trabajador surta efectos compensatorios respecto a los beneficios
sociales reclamados por el trabajador y ordenados a pagar por las instancias
previas.
En tal sentido, se analizará si la decisión adoptada por la Corte Suprema en el
caso en concreto se ajusta a derecho o si, por el contrario, correspondía que la
empresa efectúe el reintegro de los beneficios sociales requeridos por el
demandante. Para tal efecto, será necesario examinar conceptos jurídicos
relevantes como el principio protector al trabajador y la irrenunciabilidad de
derechos, así como el carácter compensatorio de las sumas otorgadas con
ocasión del cese del trabajador, el incentivo a la renuncia, ente otros, que
permitirán brindar respuesta al problema principal planteado.
The purpose of this legal report is to make a critical analysis of the decision made by the Supreme Court in the Labor Cassation No. 10273-2020-Lima, which analysed the correct application of Article 57° of Supreme Decree No. 001-97- TR, T.U.O. of Legislative Decree No. 650, the Law of Compensation for Time of Services, to determine whether the amount granted upon termination of the worker should produce compensatory effects with respect to the social benefits claimed by the worker and ordered to be paid by the previous instances. In this sense, we will analyse whether the decision adopted by the Supreme Court in the specific case is adjusted to the law or whether, on the contrary, the company should reimburse the social benefits requested by the plaintiff. For this purpose, it will be necessary to examine relevant legal concepts such as the principle of worker protection and the unwaivability of rights, as well as the compensatory nature of the sums granted upon termination of the employee, the incentive to resign, among others, which will allow to answer the main problem raised.
