Hacia la búsqueda de la resocialización de los adolescentes infractores a la ley penal peruana: la inaplicación de plazos regulados legalmente para solicitar la variación de internamiento

Abstract
La presente investigación aborda la importancia de aplicar el control difuso para
inaplicar los plazos establecidos en los numerales 1 y 5 del artículo 164 del
Código de Responsabilidad Penal del Adolescente, los cuales condicionan la
solicitud de variación de internamiento del adolescente infractor al cumplimiento
de un tercio o tres cuartos de la duración de la precitada medida. Así, el objetivo
principal se centra en establecer fundamentos jurídicos sólidos para fundamentar
la flexibilización de los plazos con el fin de priorizar el progreso del adolescente
en su reinserción. Ello con la finalidad de que el infractor pueda contar con una
medida menos lesiva de la privación de la libertad o prescindir de ella,
destacando que el infractor permanezca el menor tiempo posible dentro de un
centro juvenil. Todo ello se realiza a partir de un análisis exhaustivo de la
normativa vigente tanto a nivel nacional como internacional y la revisión de casos
judiciales para determinar las limitaciones de los plazos establecidos y el efecto
negativo que presenta en la reinserción del adolescente. Los resultados indican
que la normativa de la variación de internamiento vulnera principalmente el
principio del interés superior del niño porque no garantiza su tratamiento, sino
que establece sanciones severas para personas que se encuentran en pleno
desarrollo. Además, se destaca que la evaluación continua es esencial para una
adecuada reinserción social. Por todo ello, se concluye que la normativa peruana
debe rectificar su regulación y alinearse con las normas internacionales, para
que se promueva medidas de privación de libertad para adolescentes más
efectivas y humanizadas.
The present research addresses the importance of applying diffuse control to override the deadlines established in numerals 1 and 5 of article 164 of the Code of Criminal Responsibility for Adolescents, which condition the request for variation of confinement of the adolescent offender to compliance with 1/ 3 or ¾ of the aforementioned measurement. Thus, the main objective focuses on establishing solid legal foundations to fundamentally make the deadlines more flexible in order to prioritize the adolescent's progress in their reintegration. This is so that the offender can count on a less harmful measure of deprivation of liberty or do without it, highlighting that the offender remains as short a time as possible in a juvenile center. All of this is carried out based on an exhaustive analysis of current regulations both nationally and internationally and the review of judicial cases to determine the limitations of the established deadlines and the negative effect it has on the adolescent's reintegration. The results indicate that the regulation of the variation of confinement mainly violates the principle of the best interests of the child because it does not guarantee the child's treatment, but rather establishes severe sanctions for people who are in full development. Furthermore, it is highlighted that continuous evaluation is essential for adequate social reintegration. For all these reasons, it is concluded that Peruvian regulations must justify their regulation and align with international standards to promote more effective and humane measures.
