Informe jurídico sobre la Resolución N°4964-2024- SUNARP-TR (NSIR-T)

Abstract

La Resolución N° 4964-2024-SUNARP-TR desarrolla un caso particular, la Cooperativa Agraria de Usuarios “Virgen del Carmen” Ltda. 083-VII Ccayara- Chacanticra inscribe su extinción el 14 de noviembre del 2012, el 26 de marzo del 2012 la comisión liquidadora de la cooperativa suscribió una escritura pública de donación a favor de la Comunidad Campesina de Ccayara y el 21 de agosto del 2024 se presenta la solicitud de inscripción de la donación en el registro de predios. Lo cual conlleva un problema, pues una vez que la cooperativa inscribe su extinción, esta deja de existir por lo cual no podría realizar negocios jurídicos con terceros lo que implica que la transferencia no podría ser inscrita. Esto generaría un problema en el registro, pues ya no reflejaría la realidad y un bien inmueble se quedaría sin titular real ya que no se puede transferir. En el presente caso, el Tribunal Registral utilizó un precedente de observancia obligatoria para poder resolver el problema e inscribir la transferencia. Es así que mediante el presente trabajo sustentaré por qué el precedente no se debería aplicar al caso, identificando los requisitos que se deben cumplir para que este se pueda utilizar y el por qué este precedente es contrario al ordenamiento jurídico, analizando diversos plenos registrales y consultando jurisprudencia y doctrina.

The Resolution N° 4964-2024-SUNARP-TR develops a particular case, the Cooperativa Agraria de Usuarios “Virgen del Carmen” Ltda. 083-VII Ccayara- Chacanticra register its extinction on November 14, 2012; on March 26, 2012 the liquidation commission of the cooperativa signed a public deed of donation in favor of the Comunidad Campesina de Ccayara and on August 21, 2024 the application for the registration of the donation in the property registry is submitted. Which entails a problem, because once the cooperative registers its extinction, it ceases to exist therefore it could not conduct legal business with third parties, which implies that the transfer could not be registered. This would generate a problem in the registration, since it would no longer reflect reality and a real estate would be left without a real owner since it cannot be transferred. In the present case, the Registry Court used a binding precedent to be able to resolve the problem and register the transfer . Thus, through this work I would support why the precedent should not be applied to the case, identifying the requirements that must be met so that it can be used and what this precedent is contrary to the legal system, analyzing various registry plenary and consulting jurisprudence and doctrine.
