La aplicación del “Protocolo del Ministerio Público para la investigación de los delitos de feminicidio desde la perspectiva de género” (2018) en la investigación penal de tres feminicidios de mujeres trans en el Perú entre 2018 y 2023

Abstract

Esta tesis tiene como objetivo determinar y analizar de qué manera se aplicó el “Protocolo del Ministerio Público para la Investigación de los Delitos de Feminicidio desde la perspectiva de género” (2018) en las investigaciones fiscales de los feminicidios de tres mujeres trans: Jamileth (2018), Patricia (2021) y Camila (2023). Este documento de obligatorio cumplimiento para los representantes del Ministerio Público ha sido elegido por ser un instrumento que materializa los estándares de derechos humanos para la investigación del delito de feminicidio, desde un enfoque de género interseccional. La metodología para esta investigación será el análisis jurídico documental de las actuaciones fiscales llevadas a cabo. Las disposiciones han sido agrupadas en tres categorías de criterios de análisis: enfoque de género interseccional, oficiosidad y debida diligencia y respeto y participación de los familiares. Esta investigación concluye en que en las tres investigaciones fiscales no se aplicó el tipo penal de feminicidio, invisibilizando la identidad transfemenina de las víctimas; así como tampoco se desarrollan líneas de investigación que tomaran en cuenta elementos de contexto cruciales, tales como el crimen organizado, la prostitución o las motivaciones transfóbicas. Justificaciones para el archivo, como la autonomía de la institución para filtrar los casos con poca probabilidad de éxito, o el uso de procesos especiales como la terminación anticipada, impidieron encontrar justicia a las mujeres trans, su familia y su comunidad, ocultando la falta de debida diligencia y el desconocimiento sobre derechos humanos.

This thesis aims to determine and analyze how the "Protocol of the Public Prosecutor's Office for the Investigation of Femicide Crimes from a Gender Perspective" (2018) was applied in the prosecutorial investigations of the femicides of three trans women: Jamileth (2018), Patricia (2021), and Camila (2023). This document, which is mandatory for representatives of the Public Prosecutor's Office, was chosen because it embodies human rights standards for the investigation of the crime of femicide from an intersectional gender perspective. The methodology for this research will be a documentary legal analysis of the prosecutorial actions carried out. The provisions have been grouped into three sets of analytical criteria: an intersectional gender approach, officiousness and due diligence, and respect for and participation of the victims’ families. This investigation concludes that the criminal offense of femicide was not applied in the three prosecutorial investigations, rendering the victims' transgender identities invisible. Nor were lines of investigation developed that would take into account crucial contextual elements, such as organized crime, prostitution, or transphobic motivations. Justifications for closing the case, such as the institution's autonomy to filter out cases with little chance of success, or the use of special processes such as early termination, prevented the trans women, their families, and their communities from finding justice, obscuring the lack of due diligence and ignorance of human rights.
