Resumen
El presente informe examina la Resolución N.º 2189-2025/SPC-INDECOPI,
mediante la cual la Sala Especializada en Protección al Consumidor determinó
que el apagado deliberado de las luces durante un partido organizado por el Club
Alianza Lima configuró un riesgo injustificado para la seguridad e integridad de
los consumidores. El acto analizado en la referida resolución consiste en la
evolución de disponer la implementación obligatoria de un programa de
cumplimiento normativo como medida correctiva complementaria frente a la
gravedad del hecho, magnitud del riesgo generado y deficiencias en los
mecanismos internos del club deportivo. La Resolución 2189-2025/SPCINDECOPI
representa un caso emblemático no solo por involucrar a un club
deportivo de amplia notoriedad nacional e incluso internacional, sino que además
marca un precedente significativo en materia de protección al consumidor en el
ámbito de los eventos deportivos, constituyéndose en una referencia para la
gestión de riesgos y el deber de seguridad en futuros espectáculos de esta
naturaleza.
This report examines Resolution No. 2189-2025/SPC-INDECOPI, through which the Specialized Chamber for Consumer Protection determined that the deliberate shutdown of the stadium lights during a match organized by Club Alianza Lima constituted an unjustified risk to the safety and integrity of consumers. The decision analyzed in said resolution concerns the possibility of ordering the mandatory implementation of a compliance program as a supplementary corrective measure, in light of the seriousness of the event, the magnitude of the risk generated, and the deficiencies observed in the club’s internal mechanisms. Resolution 2189-2025/SPC-INDECOPI constitutes a landmark case not only because it involves a sports club of wide national and even international recognition, but also because it establishes a significant precedent in consumer protection within the context of sporting events, becoming a reference point for risk management and the duty to ensure safety in future events of this nature
