Abstract
El presente trabajo tiene por objetivo ofrecer un análisis de la Resolución de Sala
Plena No. 001-2024-SUNAFIL/TFL recaído en el expediente No. 601-2021-
SUNAFIL/IRE-AQP que aborda la denuncia presentada por las empleadas
sindicalizadas contra Fábrica de Chocolates La Ibérica S.A. Se propone analizar
cómo se aplica el principio de exceso de punición considerando criterios de
razonabilidad y proporcionalidad como función discrecional de la administración
de trabajo para determinar la sanción de una infracción muy grave (Art. 25.14
LRCT). Adicionalmente, se estudia cómo esta función administrativa e inspectiva
de SUNAFIL puede complementarse con el rol de las organizaciones sindicales
para intervenir de manera más célere y eficaz ante un comportamiento infractor
por parte del empleador.
The case offers an analysis of the Plenary Chamber Resolution No. 001-2024- SUNAFIL/TFL issued in file No. 601-2021-SUNAFIL/IRE-AQP for the complaint filed by the unionized workers against the company “La Ibérica Chocolate Factory S.A.” In this sense, it is proposed to analyze how the principle of excessive punishment is applied, considering criteria of reasonableness and proportionality as a discretionary function of the labor administration to determine the sanctions for a very serious infringement (Art. 25.14 LRCT). Additionally, it explores how this administrative and inspection function of SUNAFIL can be complemented by the role of labor unions to intervene more quickly and effectively in cases of employer misconduct.
