Resumen
El presente informe jurídico analiza la Resolución N° 3341-2023/SPC, bajo la cual, la
asociación de consumidores Nouvelle Defense denuncia a Conecta Market por
presuntamente haber infringido el deber de información al no haber contemplado en su
página web características como la memoria de almacenamiento, el sistema operativo,
la memoria RAM, el procesador y el año de lanzamiento de los Smart TV que
promocionaba. En razón de ello, se evaluará si la decisión emitida por Indecopi sobre
información relevante en televisores inteligentes se encuentra alineada con la realidad
tecnológica, el uso que se le brinda a estos dispositivos, la información necesaria para
la decisión de compra y el estándar de consumidor aplicable al caso.
A su vez, como parte del análisis a realizar, se examinará si se respetó el principio de
predictibilidad de los administrados al realizar una variación de criterio en tan solo tres
meses y sin un sustento adecuado que lo justifique, vulnerando así la seguridad jurídica
del ordenamiento.
Por último, se resaltará la importancia de contar con pronunciamientos que se
encuentren alineados a la información relevante de productos tecnológicos con una
naturaleza cambiante. A su vez, se desarrollará la importancia de la emisión de
resoluciones que resguarden la seguridad jurídica.
The present legal report analyzes Resolution N° 3341-2023/SPC, under which the consumer association Nouvelle Defense denounces Conecta Market for allegedly having infringed the duty to provide information by failing to include on its website characteristics such as storage memory, operating system, RAM, processor, and release year of the Smart TV it was promoting. Therefore, an evaluation will be made of whether the decision issued by Indecopi on relevant information on smart TV’s is aligned with the technological reality, the use of these devices, the information necessary for the purchase decision, and the consumer standards applicable to the case. In turn, as part of the analysis to be carried out, it will be determined whether the principle of predictability of the governed parties was respected by making a change in criteria without adequate motivation and support, thus violating the legal certainty of the legal system. Finally, it will be recommended (i) to have pronouncements that are aligned with the relevant information appropriate to technological products with a changing nature and (ii) the importance of issuing resolutions that safeguards legal security.
