Abstract
En el presente informe trataremos la casación 1500-2007 relativa a un caso de divorcio por
causal dentro de la cual se discutió la imposibilidad de hacer vida en común como causal de
divorcio, en una primera instancia se le dio la razón a la demandante, sin embargo, esta sentencia
se elevó a consulta, donde se desestimó la sentencia de primera instancia, posteriormente se
interpuso una primera casación, la cual anulo la sentencia en segunda instancia pero siguió
desestimando la sentencia en primera instancias, finalmente se interpuso segunda casación
mediante el uso del Novit Curia la sala procedió a resolver el proceso en favor de la demandante
otorgándole finalmente el divorcio de su exesposo, analizaremos primero de manera breve lo
que concierne a la institución del matrimonio y a modo de mención la responsabilidades,
derechos y/o obligaciones que esta conlleva, para que así podamos adéntranos en las doce
causales de divorcio comprendidas dentro de nuestra legislación deteniéndonos en cada una
para verificar los supuestos de hecho que pueden corroborarse dentro de las mismas, y así poder
analizar si es que se eligió la correcta y si los jueces dieron un correcto análisis de los hechos
del caso.
