Abstract
El presente informe jurídico busca determinar si los créditos de titularidad de
OEFA por conceptos de capital e intereses están comprendidos en el concurso
de la empresa Doe Run Perú S.R.L. en Liquidación, teniendo presente que estos
devengaron durante la liquidación en marcha. En ese sentido, se observa la
importancia de la división de los créditos concursales y post concursales, así
como la importancia de la suspensión de exigibilidad de obligaciones. Del mismo
modo, se determinan cuáles son los efectos del acuerdo de liquidación y
disolución sobre los créditos. Así como, las excepciones particulares para el caso
de la liquidación en marcha y, dentro de ella, se destaca la importancia de la
resolución N° 0226-2016/SCO-INDECOPI por su precedente de observancia
obligatoria respecto a los criterios para determinar qué créditos se encuentran
excluidos del fuero de atracción concursal de créditos. Con el cual, además del
uso de jurisprudencia y doctrina en la materia, se logra concluir que los créditos
de OEFA se encuentran dentro del fuero de atracción concursal, pues no
superan el análisis de necesariedad realizado, de acuerdo al artículo 74.8 de la
Ley General del Sistema Concursal. Identificado ello, a través del principio de
accesoriedad se determina que es necesario aplicar las reglas del concurso
identificadas en el convenio de liquidación de la empresa.
This legal report seeks to determine whether OEFA's claims for principal and interest are included in the insolvency proceedings of the company Doe Run Perú S.R.L. in liquidation, bearing in mind that they accrued during the ongoing liquidation. In this sense, the importance of the division of bankruptcy and post-bankruptcy credits is observed, as well as the importance of the suspension of enforceability of obligations. Likewise, the effects of the liquidation and dissolution agreement on the credits are determined. As well as, the particular exceptions for the case of liquidation in progress and, within it, the importance of Resolution No. 0226-2016/SCO-INDECOPI is highlighted for its precedent of mandatory observance regarding the standards to determine which credits are excluded from the jurisdiction of bankruptcy attraction of credits. With which, in addition to the use of jurisprudence and doctrine on the matter, it is concluded that OEFA's claims are within the bankruptcy jurisdiction, since they do not pass the analysis of necessity carried out, according to Article 74.8 of the General Law of the Bankruptcy System. Having identified this, through the principle of accessory nature, it is determined that it is necessary to apply the bankruptcy rules identified in the liquidation agreement of the company.
