Informe jurídico sobre la Resolución N.°1360-2020- SUNARP-TR-L

Abstract

El presente Informe Jurídico tiene por finalidad analizar si el Tribunal Registral ha actuado conforme al principio de legalidad al exigir la incorporación de la reserva de vías en los planos y memorias descriptivas presentadas dentro de un procedimiento de actualización registral. En particular, se evalúa si esta carga —no expresamente prevista en la normativa vigente— encuentra sustento legal en el marco del Decreto Legislativo N.º 1225 y su modificatoria. Para ello, el informe desarrolla cuatro ejes fundamentales: (i) los efectos jurídicos del procedimiento de actualización registral en predios provenientes de habilitaciones semirrústicas ubicadas en zonas urbanas consolidadas; (ii) los límites legales del Decreto Legislativo N.º 1225; (iii) el régimen jurídico de la afectación vial impuesta mediante el procedimiento regular; y (iv) el respeto —o no— del principio de legalidad registral en el caso concreto. A partir del estudio normativo y doctrinario, se concluye que el Tribunal ha excedido sus competencias al introducir una exigencia no prevista legalmente, afectando así la seguridad jurídica y desnaturalizando el carácter declarativo de la actualización registral. En consecuencia, se advierte una afectación al principio de legalidad registral. Para sustentar dicho análisis, se recurrió a normativa nacional vigente, jurisprudencia registral y doctrina especializada, tanto nacional como extranjera.

The purpose of this Legal Report is to analyze whether the Registry Court has acted in accordance with the principle of legality by requiring the incorporation of the road reservation in the plans and descriptive reports submitted within a registration update procedure. In particular, the report evaluates whether this requirement -not expressly provided for in the regulations in force- is legally supported within the framework of Legislative Decree No. 1225 and its amendments. For this purpose, the report develops four fundamental axes: (i) the legal effects of the registration update procedure in properties coming from semi-rustic allotments located in consolidated urban areas; (ii) the legal limits of Legislative Decree No. 1225; (iii) the legal regime of the road affectation imposed by means of the regular procedure; and (iv) the respect -or not- of the principle of registration legality in the specific case. From the normative and doctrinal study, it is concluded that the Court has exceeded its powers by introducing a requirement not legally foreseen, thus affecting legal certainty and distorting the declaratory nature of the registry update. Consequently, the principle of registry legality is affected. In order to support such analysis, the Court resorted to national regulations in force, registry jurisprudence and specialized doctrine, both national and foreign.
