Abstract
La demandante Duberlis Caceres Ramos decide demandar al Presidente de la Corte
Superior de Justicia de Madre de Dios y a la Administradora del mismo Juzgado por
la afectación de su derecho a la lactancia materna. En dicho proceso, alega que se
vulneraron sus derechos constitucionales al trabajo libre, al descanso y al libre
desarrollo de la personalidad. En sede del Tribunal Constitucional, se resuelve que
los demandados vulneraron el derecho a la lactancia de la demandante, lo que genero
la vulneración de los derechos constitucionales a la salud familiar, al libre desarrollo
de la personalidad, la proteccion familiar, el interes superior del niño y la libertad de
trabajo, tanto de la demandante como de su hijo. En ese sentido, la controversia gira
en torno sobre si derecho a la lactancia de la demandante se vio efectivamente
vulnerado. Para resolver los problemas juridicos identificados en el caso, se utilizará
la Constitución Politica del Perú, las leyes nacionales e internacionales, la
jurisprudencia nacional del Tribunal Constitucional, y la doctrina pertinente. Se
concluye que el derecho a la lactancia fue vulnerado por los demandados, porque
participaron activamente en la vulneración de los derechos alegados por la
demandante. Asimismo, el derecho a la lactancia esta legalmente vinculado a una
serie de derechos constitucionales, los cuales se ven afectados cuando dicho derecho
es vulnerado en la práctica.
The plaintiff Duberlis Caceres Ramos decides to sue the President of the Superior Court of Justice of Madre de Dios and the Administrator of the same Court for the violation of her right to breastfeeding. In said process, she alleges that her constitutional rights to free work, rest and the free development of her personality were violated. At the headquarters of the Constitutional Court, it is resolved that the defendants violated the plaintiff's right to breastfeeding, which generated the violation of the constitutional rights to family health, free development of personality, family protection, the best interest of the child and freedom to work, both for the applicant and her son. In this sense, the controversy revolves around whether the plaintiff's right to breast-feeding was effectively violated. To solve the legal problems identified in the case, the Political Constitution of Peru, national and international laws, the national jurisprudence of the Constitutional Court, and the relevant doctrine will be used. It is concluded that the right to breastfeeding was violated by the defendants, because they actively participated in the violation of the rights alleged by the plaintiff. Likewise, the right to breastfeeding is legally linked to a series of constitutional rights, which are affected when said right is violated in practice.
