Resumen
El presente caso busca resolver el alcance del análisis realizado por el tribunal
de fiscalización laboral en materia de hostigamiento sexual laboral, dentro del
cual se cuestiona si el desarrollo jurídico, desde las funciones y competencias
propias, lo limitan a revisar aspectos formales basados en el cumplimiento de la
normativa sociolaboral desde el respeto del principio de legalidad o si también
suponen la observación de aspectos sustantivos. Asimismo, dentro del análisis
mencionado, se cuestiona el rol de la empresa como responsable de generar
un ambiente seguro y saludable, así como una investigación objetiva en
resguardo de los derechos afectados de la persona hostigada. Para ello, el
presente informe dispuso de los materiales normativos en materia laboral tanto
nacional como internacional, así como de la doctrina y jurisprudencia
disponible. En vista de lo mencionado, se pudo arribar a la conclusión de que el
tribunal se encuentra facultado para realizar un análisis sobre lo impugnado en
el recurso de revisión, inclusive si considera las pruebas proporcionadas dentro
del proceso ampliando su efectividad no solo en la aplicación de multas, sino
también proporcionando un enfoque preventivo y de garantía de los derechos
relacionados a la dignidad, salud e integridad de los/as trabajadores/as.
Finalmente, el análisis sobre la obligación determinada en este tipo de casos
genera también un impacto dentro de la actuación de la empresa, inclusive
antes de la configuración de cualquier conducta hostigante como la
mencionada, así como en el proceso de investigación y decisión final respecto
a la misma.
This case seeks to resolve the scope of the analysis carried out by the labor inspection court in matters of sexual harassment in the workplace, in which it is questioned whether the legal development, from the functions and competencies, limit it to reviewing formal aspects based on compliance with the social and labor regulations from the respect of the principle of legality or if they also involve the observation of substantive elements. Likewise, within the aforementioned analysis, the role of the company as responsible for generating a safe and healthy environment is questioned, as well as an objective investigation to safeguard the affected rights of the harassed person. For this purpose, this report made use of the normative materials on labor matters, both national and international, as well as the available doctrine and jurisprudence. Given the above, it was possible to conclude that the court is empowered to analyze what was challenged in the appeal for review, even if it considers the evidence provided in the process, expanding its effectiveness not only in the application of fines but also providing a preventive approach and guaranteeing the rights related to the dignity, health and integrity of employees. Finally, the analysis of the obligation determined in this type of case also has an impact on the company's actions, even before the configuration of any harassing conduct such as the one mentioned, as well as in the process of investigation and final decision regarding the same.
