Análisis jurídico del trabajo infantil en el Perú, desde la perspectiva de la Doctrina de Protección Integral

Abstract
El trabajo infantil es un problema multidimensional que es difícil separarlo de los
componentes económicos y culturales de un país, afectando en la actualidad a diversos
Estados, siendo por ello un objetivo crucial la erradicación, prevención y abolición del
mismo. Entendido así la problemática del trabajo infantil, el presente trabajo tiene por
objetivo verificar si en la actualidad el Estado Peruano regula demanera efectiva el trabajo
infantil, considerando los principios jurídicos de la Doctrina de Protección Integral, con la
finalidad de resguardar el desarrollo integral de los niños, niñas y adolescentes que
desempeñan una actividad laboral a pesar de su corta edad.
Para ello, se ha procedido analizar las corrientes doctrinarias relacionados a legislación
de niños, niñas y adolescentes que han sido enfocados y aplicados a lo largo de la historia;
asimismo, se ha procedido a revisar la normativa internacional y nacional vigente,
teniendo en consideración las estadísticas de las fuentes e instituciones oficiales de
nuestro país, sin dejar de lado el estudio concreto de los programas y políticas sociales
relacionadas a la lucha del trabajo infantil, impartidas por las principales autoridades.
Aunado a ello, se evidencia que la lucha contra el trabajo infantil en nuestro país no es
una tarea exclusiva del Estado, sino por el contrario, es necesario desarrollar un trabajo
más concatenado, involucrando a diversos autores como son las empresas del sector
privado, organizaciones de trabajadores y organizaciones no gubernamentales, siguiendo
el ejemplo de diversos países.
Child labor is a multidimensional problem that is difficult to separate from a country’s cultural and economic components, affecting the current situation in different governments on a global level; therefore a crucial objective for several countries is eradication, prevention and abolition of child labor in their society. Therefore, this paper aims to verify if the Peruvian government currently regulates child labor effectively, considering the legal principles of the Doctrine of Comprehensive Protection, in order to protect the integral Development of Children and Adolescents who perform labor activities despite their young age. For this, we have proceeded to analyze dogmatic trends related to children and adolescents that have focused throughout history, likewise, international and national regulation in force have been reviewed, taking into consideration sources and official institutions’ statistics of our country, without neglecting the specific study of programs and social policies related to the struggle against child labor, taught by the main authorities. In addition with it, we will point out that the struggle against child labor in our country is not a Government’s exclusive task but, on the contrary, it is necessary to develop a more concatenated work, involving several agents such as private sector companies, workers' rights organizations and Non-governmental organizations, following the example of several countries.
