Deficiencias en el sistema de justicia en Perú: Un análisis del caso Saweto y sus implicaciones para la protección de defensores ambientales

Abstract

El caso Saweto expone las graves fallas del sistema judicial peruano en la protección de defensores del medio ambiente. En 2014, cuatro líderes indígenas Asháninkas de Saweto, Ucayali, fueron asesinados por denunciar la tala ilegal en sus tierras. Este trágico suceso no solo mostró la vulnerabilidad de estos defensores, sino también la lentitud y falta de coordinación de la justicia, que tardó casi una década en condenar a los responsables. Si bien se han implementado algunas medidas como el Mecanismo Intersectorial para la Protección de Defensores de Derechos Humanos y la Ley General del Ambiente que reconoce el derecho a un entorno saludable. A nivel internacional, el Acuerdo de Escazú resalta la importancia de proteger a estos defensores, aunque Perú aún no lo ha ratificado. Estas leyes buscan garantizar la protección de los derechos humanos y el acceso a la justicia. El caso Saweto deja lecciones importantes, ya que resalta la urgencia de reformas judiciales que incluyan la digitalización de procesos, la creación de juzgados especializados en conflictos socioambientales y la titulación de territorios indígenas. También subraya la necesidad de mejorar la coordinación entre instituciones y fomentar el respeto por los derechos humanos y ambientales. Solo un sistema judicial eficiente y sensible puede combatir la impunidad y proteger a quienes defienden el medio ambiente.

The Saweto case exposes the serious failures of the Peruvian judicial system in protecting environmental defenders. In 2014, four Asháninka indigenous leaders from Saweto, Ucayali, were murdered for reporting illegal logging on their lands. This tragic event not only highlighted the vulnerability of these defenders but also the slow and uncoordinated justice system, which took nearly a decade to convict those responsible. While some measures, such as the Intersectoral Mechanism for the Protection of Human Rights Defenders and the General Environmental Law, which recognizes the right to a healthy environment, have been implemented, challenges remain. Internationally, the Escazú Agreement emphasizes the importance of protecting these defenders, although Peru has yet to ratify it. These legal frameworks aim to guarantee the protection of human rights and access to justice. The Saweto case provides significant lessons, underscoring the urgency of judicial reforms, including the digitization of processes, the establishment of specialized courts for socio-environmental conflicts, and the titling of indigenous territories. It also highlights the need to improve institutional coordination and promote respect for human and environmental rights. Only an efficient and sensitive judicial system can combat impunity and protect those who defend the environment.
