This article analyzes, from a labor perspective, the incorporation of digital business communication platforms in the workplace, specifically with the use of "Workplace", a software that has the characteristics of a social network and whose objective is to improve the flow of communication and organization among workers who share the same workplace. Thus, after addressing the characteristics and objectives of this social network, as well as the type of information of a labor and personal nature that is shared in the profiles of each worker, we proceed to develop an analysis from the perspective of Peruvian labor law, in which we question whether the use of this platform would jeopardize the protection and respect for the labor rights of workers and, in turn, whether this would imply an excess in the exercise of the employer's powers. On the one hand, a balance of the information shared is made regarding what type of data can be used for labor purposes and which others could imply an undermining of the dignity and protection of the personal data of each worker. Although Peruvian legislation does not specifically regulate the protection of the latter in the labor sphere, it is possible to make an analysis based on doctrinal and jurisprudential information. Taking into account this and the negative implications that could result from the misuse of this type of platforms and the decisions taken by the employer regarding the incorporation of this in the workplace, the limits of the latter regarding the use of this digital tool and the mechanisms that can be adopted for its implementation are analyzed. With regard to the conclusions, the importance of an explicit expression of will on the part of the worker to have a corporate social profile in which sensitive information is shared with prior consent is highlighted, but also that the employer establishes limits on the requirements regarding its use and the information that is published, based on the adoption of mechanisms that prioritize respect for the labor and fundamental rights of each worker....

Abortion is partially legal in Peru due to the fact that it can only be done in some cases, such as a therapeutic, sentimental or eugenic abortion procedure, which can be found in articles 119 and 120 from the Penal Code. Such scenario suggests that the life of women must be in danger in order to ask for an abortion, which leads us to question why is it illegal to have a free, voluntary and legal abortion procedure in Peru, in which it would be women who choose whether to have it or not. So, this work picks up that question and constructs another one: why does the criminal law violate the rights of women who wish to have an abortion done? As a hypothesis, this narrative suggests that the peruvian regulation of abortion is actually a punishment for women as it gives absolute worth to the embryo and its right to live, while lacking to protect some of the following rights that women have: the right to the free development of personality, the right to health, the right to a physical and mental integrity, the right to not be treated as means to an end, meanwhile choosing to ignore the recommendations from international organisms which defend the decriminalization of abortion. So, this work explains that the regulation of abortion in Peru lacks of lawful arguments, violates the rights of women, sympathizes with prolife affirmations and is not suitable to achieve the aim of protection of legal assets common in a constitutional state of law....

This article seeks to analyze the <<<suitability/necessity/appropriateness>>> of Prior Consultation during the development of mining activities, in order to determine whether the granting of mining concession titles that are superimposed on Indigenous or Original Peoples' territories should be subject to a process of prior consultation. To achieve this, there are three sections: the first of which addresses the most relevant legal aspects of prior consultation, paying special attention to the international and national regulations related to this right. Additionally, this section makes reference to the timeliness of prior consultation, since the identification of the moment of its implementation is fundamental to fully exercising this collective right. The second section develops the regulations of prior consultation, specifically in the mining subsector, describing the phases of the mining activity, the mining licences required for the execution of the project and the effects they generate, culminating with the implementation of consultation in this subsector. Finally, the third section presents the arguments why the granting of mining concession titles that are superimposed on Indigenous or Original Peoples' territories should be subject to a prior consultation process, since the granting of mining concessions directly affects the collective rights of these peoples. Reference is also made to the regulation and implementation of this collective right in other countries in the region. Based on the above, it is recommended to amend Ministerial Resolution No. 403-2019- MINEM/DM to incorporate mining concession titles to the list of mining administrative procedures that require prior consultation....

The principles of Administrative Law are normative statements that form the basis for the application and interpretation of the Law, through which the power of the entities is directed in order to respect the rights of those administered. In that respect, the application of these principles In law it is essential. However, it has been verified that in various Indecopi pronouncements the Principle of Legitimate Trust is not being applied, which provides legal value to the objective expectations generated by the administrator, which would cause legal uncertainty. In this article I am going to analyze the aforementioned problem, studying the principle itself, its foundations and importance, and the current applicable regulations. In addition, I am going to analyze some resolutions of Indecopi, on packaged food products, in which it ignores the powers of a competent sectoral entity by not taking into account the enabling titles that it issues, thus causing legal uncertainty for those administered who are confused when have two different opinions from two entities of the Public Administration. Finally, in the final part of this article a possible solution to the identified problem is proposed, which seeks to define the powers of the two entities based on the legal objects that each one protects, setting limits on their actions according to said powers....
