This legal report analyzes the Judgment issued of the Constitutional Court, which states that the involuntary hospitalization of a person with mental disabilities, such as those persons diagnosed with schizophrenia, is justified beyond what is established by the law in the matter, and that it grants all persons with disabilities legal capacity to fully enjoy their rights and be treated on equal terms with other people. has been established by law on the matter and which provides all persons with disabilities with legal capacity to fully enjoy their rights and to be treated on an equal footing with other people. Pursuant to the decision of the Second Commercial Chamber in the annulment of the award filed by Química Suiza S.A. against Dongo-Soria, Gaveglio y Asociados S.R.L. in case No. 155-2012, this report analyzes the following two legal issues. First, this report will analyze whether the arbitral award that is the object of the annulment of the award violated the right to evidence and the right to a reasoned arbitral award. To this end, it will evaluate the standard of reasoning of arbitral awards and the implications of the right to the evaluation of evidence. Secondly, it will be analyzed whether the arbitral award in question affects the right to be judged under the principles of independence and impartiality, due to a travel made by one of the arbitrators together with the attorney of one of the parties. As a result of this analysis, a proposal is made in order to solve the problems related to the requirement of a prior claim in arbitration as a requirement to procedural denial for the annulment of the arbitral award, when this is not possible for any reason....

The objective of this legal report is to analyze Labor Cassation No. 5448-2017 from which various very important legal problems arise. The main one deals with whether it is valid for the parties (SUTEMAPEL minority union and Municipal Toll Administrator company of Lima S.A.- EMAPEL S.A) to extend the benefits agreed in the collective agreements to unaffiliated workers; since, it could or could not affect fundamental rights such as freedom of association, both its positive or negative modality, or the right to equality. Finally, the appropriate mechanism to challenge a collective agreement will be indicated and the actions that workers affiliated to the SUTEMAPEL minority union can carry out when their representatives negotiate and agree to extend the benefits of collective agreements to workers not affiliated with the minority union will be correctly appreciated. SUTEMAPEL, by representing a potential risk to the subsistence of the SUTEMAPEL minority union itself. This report analyzes the controversy that arose between the company Multiservis Clave 90 E.I.R.L. and the Provincial Municipality of Arequipa, following the issuance of a municipal ordinance by said public entity that, according to the aforementioned company in the amparo lawsuit filed, represented a violation of its fundamental rights to freedom of work and business. Thus, the main objective is to determine whether or not the requirements contained in the aforementioned ordinance, a rule that would constitute the act that violates such rights, constitute illegal and/or unreasonable bureaucratic barriers, in addition to the relevance of elucidating this controversy through of the application for protection or, on the contrary, resorting to an equally satisfactory route.
