Groups of companies constitute a business reality that has been consolidated as one of the legal figures that make up the phenomenon of business concentration, whose boom has been increasing until today. This form of business organization is characterized by being made up of various legal subjects, formally independent and covered with their own legal personality that, however, act under a common economic direction. Even though it is a daily phenomenon in our days, Peruvian legislation has not provided for a special law that regulates groups of companies in all their aspects; indeed, although there are sectoral rules that regulate them according to their nature, in labor matters there is a legal gap. Precisely, due to the absence of regulations described above, jurisprudence has taken a leading role in the resolution of disputes that arise within the framework of this business phenomenon. By virtue of the above, the present research work has as its starting point the existing legal gap with respect to groups of companies in Peruvian Labor Law (individual and collective scope). In addition, the aim is to address the main legal problems identified as individuals and collectives in the context of group of companies; as well as to make a healthy criticism of the judicial decisions issued. This, with the genuine purpose of providing a pragmatic solution –and we hope wise– that can be well received by our justice operators....

The objective of this legal report is to analyze the complaint for the alleged existence of a bureaucratic barrier, filed by Geo Supply SAC, a telecommunications company dedicated to the provision of the public mobile satellite service, against the Ministry of Transport and Telecommunications, an administrative entity in charge of the calculation and collection of the fee for the use of the radioelectric spectrum. The aforementioned complaint is intended for Indecopi to declare the non-application of the fee calculation methodology to its specific case, considering that it constitutes an illegal and irrational bureaucratic barrier. The case under analysis presents a complex legal issue, which starts by determining the nature of the collection of the fee made by the Ministry of Transportation and Communications. Depending on the position taken, the legal consequences will be diametrically different. In 2 this way, there are problems related to the conceptualization of the tax, its characteristics, the limits of the tax authority, the powers of the administrative bodies, the constitutional interpretation and the ideal way to question the confiscatory nature of a tax. These matters have implications of significant economic and legal value, since the criteria that resolve this case are applicable to similar charges made by the State for other types of natural resources. In this context, the present case invites us to explore the connections between tax law, telecommunications law, administrative law, framed in the theory of a Constitutional State of Law, so it is necessary to use the tools of the theory general of law. In this sense, the hypothesis of this report maintains that the fee for the use of the radioelectric spectrum has a tax nature, specifically it qualifies as a rate, of the right kind, which is distinguished from public prices. Consequently, in this report it will be argued that the way to question the reasonableness of the collection is through a constitutionality control (confiscatory), which is not part of Indecopi's competence, since there are other relevant channels, such as the process tax litigation or constitutional processes of popular action or protection....

This paper focuses its analysis on the Cieza Sisters Case and the judgment issued by the Constitutional Court (Exp.00853-2015-PA/TC). From this, it addresses the problems of form and, to a greater extent, those of substance, where the complexity of the case is concentrated. The rights challenged in the case are equality and education. Regarding the former, it is argued that the Court should not have applied the equality test, since, with respect to the defendant UGEL-Utcubamba, it is a case of discrimination by indifference, as well as indirect discrimination. Likewise, the deficit of accessibility and availability of the rural educational service identified in the judgment should have been explained on the basis of an analysis of intersectional and structural discrimination. Therefore, the UGEL-Utcubamba violated the appellants' right to equality. Consequently, the Court should have evaluated this principle-right on the merits. With respect to education, the UGEL-Utcubamba violated this right because its rejection of the plaintiffs' request to recognize their enrollment in a CEBR, instead of a CEBA, prevented their access to educational services. In addition, the case shows that state institutions have failed to ensure the minimum conditions for rural educational services. Finally, the paper affirms that the Court's declaration of the ECI was correct, because the requirements for its issuance were met and because it serves as a measure of recognition....

Biodiversity conservation mechanisms known as natural protected areas have been severely criticized worldwide for frequently incurring in numerous violations of the rights of Indigenous Peoples, since a high percentage of protected areas around the world have been established in territories inhabited by Indigenous Peoples. Faced with this challenge, several countries in Latin America have developed mechanisms for co-management of natural protected areas that seek to establish a dialogue between the Indigenous Peoples' vision of territorial management and that of the State. The programmes of co-management of natural protected areas are diverse, but most of them have arisen in response to the demand of Indigenous Peoples to guarantee the protection of their rights, changing the paradigm of conservation models controlled entirely by the State, for models that are more inclusive and that seek to share the administration with the communities that inhabit these territories. The objective of this research is to measure the level of protection of the right to self-determination of Indigenous Peoples in the framework of co-management programmes in natural protected areas. This analysis is based on a human rights-based approach and analyzes two case studies: the Sierra Nevada de Santa Marta and Tayrona National Parks in Colombia and the Amarakaeri Communal Reserve in Peru. This research proposes a quantitative methodology to measure the level of protection of the right to self-determination of Indigenous Peoples that offers comparable results. Through this methodology, the protection of this right is measured at three levels 1) national legal framework; 2) co-management programme of the protected area and 3) perception of the Indigenous Peoples.
