This article focuses its analysis on consent as a central and fundamental concept in International Law. Its general legal nature is addressed, its relationship with principles of International Law such as the pacta sunt servanda, consuetudo est servanda and good faith; and its classification according to the doctrine. The concept and its effects in the international sphere are rigorously defined. Likewise, consent is analyzed from the perspective of International Procedural Law, particularly from the perspective of the International Court of Justice. In this regard, the modalities of access to the jurisdiction of the International Court of Justice are addressed, as well as the prerogatives that it has to be competent in relation to the consent of the parties. Finally, the relativization of consent at the hands of the International Court of Justice is analyzed, proposing an analysis of the case of the Arbitral Award of 1899, between Guyana and Venezuela. It is concluded, in this regard, that the Court created a mistake by attempting to analyze whether the consent expressed by the States had been unequivocal....

The aim of this academic work is to carry out an analysis of the interpretation and application of the 70th Article, paragraph 5, of Law N° 28411, which is strictly related to the right to execute judgements under the effective jurisdictional protection. In order to achieve our goal, we will analyze the legal norms that allow the execution of a judgment where the enforcement respondent is the State; in that regard, as part of this investigation, there will be mention of case files where the aforementioned article is applied in Labor Courts of the Piura District; due to the fact that its application allows the enforcement of a ruling in the span of five years following the payment requirement. Given this scenario, we intend to provide a possible way out to the interpretation in the face of the collision between the right of effective jurisdiction protection and the principle of budgetary legality; since both the right and the principle come to collide in their application, as well as in the attention required from the parties....

From a critical perspective, this article aims to reflect on the scope and effects of the first binding precedent, approved in the CIX Plenary of the Registry Court, through Resolution No. 240-2013-SUNARP/PT, published in the official newspaper El Peruano on September 13, 2013. This resolution states that "the cancellation of the registration of the property right over the entire property and its consequent withdrawal from the registry due to the owner's resignation is registrable, provided that it does not affect the rights of third parties." It is essential to contemplate the importance of having binding precedents in line with current law, not only to address practical issues but also to contribute to the improvement of the registry system. In the author's opinion, the mentioned binding precedent is imprecise in its content, causing the registry system in Peru to be uncertain and unpredictable. The author suggests its modification, emphasizing the importance of the Registry Court reviewing the criteria accepted in the aforementioned binding precedent. The author proposes limiting its application only to cases where the regularization of the property at the registry level is sought due to issues such as duplicate entries, overlap, and area correction....

This work addresses the protected legal good of reproductive autonomy from the crime of forced pregnancy from International Criminal Law, regarding the ruling of the Prosecutor v. Dominic Ongwen case before the International Criminal Court. In this sense, it begins with the analysis of the historical and normative evolution of sexual and gender crimes, from the first international criminal courts such as Nuremberg and Tokyo, to the ad hoc courts of the former Yugoslavia and Rwanda. Subsequently, the ruling of the International Criminal Court on the first sanction in the history of the ICC for the crime of “forced pregnancy” is analyzed, through which we conclude that it turns out to be insufficient. With this, we consider that the International Criminal Court was able to address and develop more broadly the protected legal good of reproductive autonomy, by virtue of and application of article 21.3 of the ER on the applicable law. Therefore, our position, in this work, proposes addressing this issue from a systemic integration approach between the branches of International Criminal Law (ICL) and International Human Rights Law (IHRL) that allows us to comprehensively address the implications for the victims of the injury to the legal good protected by the crime of forced pregnancy and the human rights connected to it....
