The purpose of this Legal Report is to analyze the sense of the decision reached by the majority of the Constitutional Court in Sentence No. 00225-2017-PA/TC Lima (Telefónica del Perú S.A.A. case), in light of the right to reasonable time in the tax litigation procedure. Taking into account the specific case, both the Tax Court and SUNAT have exceeded by far the legal 3 deadlines to resolve the appeals of claim, appeal and compliance; that is, in total more than five years, a period in which the moratorium interests have increased exorbitantly. In order to determine the violation of the right to reasonable time, implicit in the right to due process, we will refer to the four criteria established by the Constitutional Court: 1) the complexity of the matter; 2) the procedural activity or conduct of the individual concerned; 3) the conduct of the public administration; and 4) the consequences that the delay produces in the legal situation of the individual concerned. Along these lines, we maintain that the breach of the reasonable term is determined by analyzing the four criteria mentioned above; in the event of an unjustified delay - as in the case of the judgment under analysis -, the direct consequence will be the nonapplication of the moratorium interest generated since the expiration of the legal term. In addition to this, the exceptions to the rule of exhaustion of prior remedies - such as the risk of irreparability or imminent threat -, which lie in the Constitutional Procedural Code, are also reconsidered in order to access the amparo process, a suitable way for the urgent protection of the affected constitutional rights....

the present report treats about the analysis carried out by the Labor Inspection Court in Resolution 717-2022-SUNAFIL/TFL-First Chamber, to determine whether or not internal scabbing is within the scope of the assumption established in Article 25.9 of the Regulations of the General Labor Inspection Law, which attributes the commission of a very serious infraction when acts that violate the free exercise of the right to strike are committed. In this regard, the Court holds that it is not possible to subsume internal scabbing because it is not expressly listed within the 3 exemplary cases contained in the regulation, which is why it cannot be sanctioned without violating the principles of typicity and legality of the administrative sanctioning law. We do not agree with this premise, since the truth is that the Constitutional Court has already established the validity of the analogical interpretation clauses, while Previsional Cassation No. 3480-2014 expressly states that internal scabbing is indeed provided for in Article 25.9 of the RLGIT. In addition to this, and even more relevant, since it is a constitutional right with international recognition, the interpretation of the referred norm in accordance with the national and international legal system should have been prioritized. This leads us to conclude that the right to strike will only find effective protection if each and every one of the conducts intended to violate it are sanctioned by article 25.9 of the RLGIT....

The decision under analysis deals with a case of discrimination based on sexual identity that occurred in 2012, with Gothic Entertainment S.A. (hereinafter Discoteca Gótica) and Godfrey Arbulú Grippa (hereinafter Ms. Arbulú) as parties to the case. The Specialised Chamber on Consumer Protection recognises the occurrence of a discriminatory act in the consumption carried out by Gothic Discotheque against Miss Arbulú because of her condition as a transsexual person. The purpose of this paper is to analyse I) what discrimination is and its application to the specific case, II) the duty of information regarding the unjustified increase in the price of admission to the Discoteca Gótica, and III) the duty of information regarding the unjustified increase in the price of admission to the Discoteca Gótica. It is imperative to mention that the Specialised Consumer Protection Court was not able to adequately handle the concepts involved in this case, nor was it able to correctly identify the discriminatory action for a suitable analysis. Therefore, through the use of national and international doctrine, both legal and interdisciplinary, it will demonstrate the need to understand what identifies the group of people who may be victims of a discriminatory act, such as the transgender community. The right to non-discrimination is a fundamental right directly linked to the right to dignity and recognised as part of human rights; the aim is not only to evaluate the specific case, but to resolve the situation of discrimination to which not only Ms. Arbulú, but any other person who is part of this historically vulnerable human group, may be a victim....

Following the filing of a class action lawsuit (acción popular) by the Interethnic Association for the Development of the Peruvian Jungle (Asociación Interétnica de Desarrollo de la Selva Peruana) challenging (i) the Fifteenth Complementary, Transitory and Final Provision of the Regulations of the Law on Prior Consultation, and (ii) the Directive that develops said Provision, the purpose of this report is to answer the legal question about the applicability or not of the prior consultation process for the development of infrastructure projects in the matters of health, education and other public services. In order to solve this question, among the normative instruments used are the Peruvian regulations on constitutional procedural law, constitutional law, administrative law and indigenous peoples' law, as well as national and international jurisprudence and doctrine on such matters. As a result of the legal analysis, it is concluded that the non-application of the prior consultation process is not appropriate, since such exemption infringes Articles 2, 3, 4 and 5 of the Prior Consultation Law and Articles 6 and 7 of Convention 169, and is disproportionate. Notwithstanding the foregoing, it is our opinion that, in the case under analysis, the Supreme Court should not have declared the retroactivity of the expulsion of the challenged regulations (nor the nullity of the administrative measures approved under such regulations), since this was not sufficiently supported in the judgment issued, exceeds its powers in the framework of the popular action process, and generates affectations to legal certainty....

First, we will examine the right to the motivation of the awards as a constitutionally protected content of the right to effective judicial protection, which, although the merits of the motivation of the awards cannot be reviewed in court, the arbitrators must demonstrate the reasoning that led them to the award in favor of one of the parties. Second, we will analyze the right to evidence in arbitration, and we will determine what is the standard of evidentiary assessment that can be challenged in the annulment process. Third, we will explain the right to be judged by an impartial and independent arbitrator as a right of the due process of arbitration, in the context of a trip made between an arbitrator and one of the lawyers representing one of the parties to the arbitration, which was not disclosed at the request of the alleged party affected by such circumstance. This article will discuss how it is the recognition of human rights of the LGBTI people within the framework of the armed conflict starting from the study of the Inter- American System of Human Rights and also from the study of the Colombian law. Thus, we will show the suffer and the structural causes of violence that have marked the lives of thousands of LGBTI people within Colombian territory in areas where there was armed confrontation between the State and illegal groups as guerrilla and paramilitaries. At the same time, we will focus on studying the differential and gender approach contemplated in the Peace Agreement, which should be transversal to the decisions taken by the Special Jurisdiction for Peace (JEP, Spanish acronym). Likewise, we will show how this approach allows us to understand the Colombian conflict in a differentiated way from the reality of diverse people and will allow us, to establish if it will be good to repaired LGBTI people in a differentiated way. Based on that, we will formulate some guidelines and parameters which can be used in the integral compensation of person with sexual and identities different in the frameworks of the Special Jurisdiction of Peace (JEP, Spanish acronym)....
