Estándar de motivación arbitral y revisión en sede judicial: ¿Qué entender por “control externo”?

Abstract
El presente trabajo académico tiene como objeto determinar que ha
de entenderse por “control externo” en el recurso de anulación de laudo, pues si
bien los jueces tienen presente la proscripción de un examen sobre el fondo del
asunto, conforme lo establece el artículo 62°.1 de la Ley de Arbitraje, parece ser
que no se tiene claridad sobre los contornos del control judicial de tipo externo,
ya que al analizar el caso en concreto terminan realizando, en algunos casos, un
reexamen de lo resuelto en la vía arbitral. Así pues, en el primer capítulo de este
trabajo nos abocamos a exponer algunas cuestiones preliminares sobre el
arbitraje y su revisión en sede judicial, a fin de determinar si la motivación arbitral
puede ser objeto de control judicial. Luego, habiendo superado este primer
“escalón”, pasamos a desarrollar, en el segundo capítulo, el contenido mínimo
de la motivación arbitral, a partir del impacto de la motivación judicial en el
arbitraje desde la teoría de la argumentación jurídica. En tercer lugar, teniendo
en cuenta los elementos de la justificación de la teoría de la argumentación
jurídica, concluimos que el control externo en el recurso de anulación de laudo
permite una revisión judicial sobre la justificación interna y externa, sin que ello
signifique una valoración pormenorizada de la controversia. Finalmente,
presentamos una propuesta normativa como complemento al propósito de este
trabajo académico.
The purpose of this academic work is to determine what must be understood by "external control" in the appeal for annulment of the award, because although the judges keep in mind the proscription of an examination on the merits of the matter, as established in article 62 of the Arbitration Law, it seems that there is no clarity about the contours of external judicial control, since when analyzing the specific case they end up carrying out, in some cases, a re examination of what was resolved in arbitration. Thus, in the first chapter of this work we focus on exposing some preliminary issues about arbitration and its review in court, in order to determine if the arbitration motivation can be subject to judicial control. Then, having overcome this first "step", we proceed to develop, in the second chapter, the minimum content of the arbitration motivation, based on the impact of judicial motivation in arbitration from the theory of legal argumentation. Thirdly, taking into account the elements of the justification of the theory of legal argumentation, we conclude that the external control in the appeal for annulment of the award allows a judicial review of the internal and external justification, without this implying a detailed assessment. of the controversy. Finally, we present a normative proposal as a complement to the purpose of this academic work.
