Violencia y acoso sexual en el mundo del trabajo a mujeres con discapacidad en Perú a propósito del Convenio N°190 de la OIT

Abstract
La problemática del acoso sexual laboral a las mujeres con
discapacidad tiene particularidades específicas como la doble vulnerabilidad
(ser mujer y tener discapacidad), la falta de reconocimiento social de los
derechos sexuales y reproductivos, la invisibilización del colectivo en los datos
estadísticos en los Ministerios. Por consiguiente, el objetivo general de la
presente investigación cualitativa es determinar si la normativa laboral
peruana respeta, promueve y asegura el derecho a las mujeres con
discapacidad a un trabajo libre de violencia y acoso en coherencia con el
Convenio N°190 de la OIT. Es por ello que la herramienta de recolección de
dato será 01 cuestionario aplicado a 30 mujeres con discapacidad. Por último,
la conclusión principal es que el Estado peruano tiene la obligación de realizar
modificaciones o adaptaciones a la legislación laboral para prevenir la
violencia y acoso a las mujeres con discapacidad antes del 08 de junio de
2023, fecha en la que entra en vigor el Convenio N°190 de la OIT.
The problem of sexual harassment at work for women with disabilities has specific characteristics such as double vulnerability (being a woman and having a disability), lack of social recognition of sexual and reproductive rights, and invisibility of the group in statistical data in Ministries. Therefore, the general objective of this qualitative research is to determine whether Peruvian labor legislation respects, promotes and ensures the right of women with disabilities to work free from violence and harassment in accordance with ILO Convention 190. The data collection tool will be a questionnaire applied to 30 women with disabilities. Finally, the main conclusion is that the Peruvian state has the obligation to make modifications or adaptations to labor legislation to prevent violence and harassment against women with disabilities before June 8, 2023, the date on which ILO Convention 190 comes into force.
