Tarjeta roja: análisis del periodo de prueba en las relaciones laborales de los futbolistas profesionales

Abstract

La presente investigación tiene como objeto analizar el periodo de prueba en la relación laboral de los futbolistas profesionales, en contraste con lo que ocurre en la legislación laboral nacional vigente. Para ello, se parte de la pregunta sobre cómo es el vínculo laboral de los futbolistas profesionales; y después, se estudia el tratamiento del periodo de prueba en nuestra legislación nacional vigente. La investigación recoge información a nivel teórico, disposiciones jurídicas normativas de la materia y laudos arbitrales de la Cámara de Conciliación y Resolución de Disputas de la Federación Deportiva Nacional Peruana de Fútbol y de FIFA. Se percibe que la aplicación del periodo de prueba no parece corresponder a la naturaleza especial de este ámbito. Finalmente, se brinda una solución priorizando la protección de los futbolistas.

The purpose of this research is to analyse the probationary period in the employment relationship of professional footballers, in contrast to what happens in the current national labour legislation. To do this, it starts from the question of what the employment relationship of professional footballers is like; and then, the treatment of the probationary period in our current national legislation is studied. The research collects information at the theoretical level, legal provisions and arbitration awards of the Chamber of Conciliation and Dispute Resolution of the Peruvian National Sports Federation of Football and FIFA. It is perceived that the application of the probationary period does not seem to correspond to the special nature of this area. Finally, a solution is provided prioritizing the protection of the players.
