Abstract
El presente trabajo académico desarrolla el contenido del principio de tipicidad
de la Potestad Sancionadora de la Administración Pública, reconocido en la Ley
del Procedimiento Administrativo General, Ley No. 27444, que contiene la
exigencia de la garantía material de taxatividad, que exige que las normas que
contengan una infracciones sean definidas con un grado de precisión y claridad
tal que puedan ser entendidas por los administrados a quienes les serán
aplicables, con el fin de que estos puedan prever sus obligaciones y guiar su
actuación de acuerdo a ellas.
En este sentido, se analiza el contenido de la tipicidad, desarrollando las
obligaciones y limitaciones aplicables a los legisladores y a las autoridades
administrativas que pueden producir normas por delegación de una norma con
rango de ley. Asimismo, se enfatiza en el caso de la potestad normativa
reglamentaria y de tipificación de los reguladores, específicamente la del
Organismos Supervisor de Inversiones en Minería y Energía.
Finalmente, se aplican los postulados propuestos a un caso práctico específico,
que se encuentra desarrollado en el marco de un Procedimiento Administrativo
Sancionador iniciado a la empresa Pacific Stratus Energy S.A por parte del
regulador al verificarse un supuesto incumplimiento de la obligación de retiro de
instalaciones de producción inactivas reconocida en el artículo 217 del
Reglamento de las Actividades de Exploración y Explotación de Hidrocarburos,
aprobado mediante Decreto Supremo No. 032-2004-EM. Con ello, se busca
verificar cuáles son las condiciones y exigencias que permiten concluir que se
cumple con respetar la observancia de este principio.
This academic work develops the content of the principle of typicity of the sanctioning power of the Public Administration, recognized in the Ley del Procedimiento Administrativo General, Ley No. 27444, which contains the requirement of material guarantee of specificity, which requires that rules be defined with a degree of precision and clarity such that they can be understood by those to whom they will be applicable, so that they can foresee their obligations and guide their actions in accordance with them. In this sense, the content of this principle, developing the obligations and limitations applicable to legislators and administrative authorities that can produce rules by delegation of a rule with status of law. Additionally, emphasis is placed on the case of regulators, specifically on the Energy and Mining Regulatory Agency of Peru. Finally, the proposed postulates are applied to a specific practical case, which is developed within the framework of an Administrative Sanctioning Procedure initiated to Pacific Stratus Energy S.A. by the regulator upon verifying an alleged breach of the obligation to remove inactive production facilities recognized in article 217 of the Reglamento de las Actividades de Exploración y Explotación de Hidrocarburos, Decreto Supremo No. 032-2004-EM. With this, the purpose is to verify which are the conditions and requirements that allow concluding that the observance of this principle is complied with.
