Reinterpretación de la "coherencia" y "uniformidad" en la declaración testimonial de mujeres con himen dilatable víctimas de violación sexual

Abstract

La presente investigación cuestiona si la interpretación de los requisitos de valoración de la declaración de la víctima de violación sexual desarrollados en el Acuerdo Plenario No. 1-2011/CJ-116 son correctos. Así, llegamos a sostener que se debe reinterpretar los requisitos de coherencia y uniformidad de los requisitos señalados en el mencionado Acuerdo. Para ello, se ha analizado el contexto de la violación sexual en el Perú, el estándar probatorio de la violación sexual y la relevancia de la prueba indiciaria y la valoración de la declaración de la víctima de violación sexual.The present investigation questions whether the interpretation of the requirements for the assessment of the rape victim's statement developed in Plenary Agreement No. 1-2011/CJ-116 are correct. Thus, we argue that the requirements of coherence and uniformity of the requirements indicated in the aforementioned Agreement should be reinterpreted. To this end, we have analyzed the context of rape in Peru, the evidentiary standard of rape and the relevance of circumstantial evidence and the assessment of the rape victim's statement.
