Abstract
El presente artículo analiza la presencia de la Inteligencia Artificial Generativa bajo
el marco normativo de Protección y Defensa del Consumidor en el Perú. Se
demostrará que, siendo el consumidor una presencia siempre vulnerable en el
mercado y nuestra regulación Pro Consumidor, este aspecto ha sido dejado de lado
en el mundo de las nuevas tecnologías, siendo este vital para el desarrollo de algo
que no conoce el consumidor peruano.
La Inteligencia Artificial se ha vuelto una herramienta para el uso comercial y el
corporativo, siendo la empresa titular de sus derechos la encargada de regular su
uso. Claramente, esta debe conocer las normas para que no ser sancionada al
momento que ofrece sus servicios. Por otro lado, el consumidor no solo no tiene
conocimiento técnico de cómo funciona las herramientas, tampoco se encuentra en
una situación en la que pueda averiguar por su cuenta de todos los usos y las
posibles infracciones que puede incurrir si usa la Inteligencia Artificial de manera
imprudente.
Por ello, el presente artículo mediante el análisis de diferentes conceptos y sectores
del Derecho en el cual el uso de la Inteligencia Artificial podría involucrarse
interpretará como un consumidor razonable, siendo este el mayor estándar al que
podemos observar en un consumidor se encuentra en una situación vulnerable, por
más que intente investigar y aprender. Adicionalmente, ello no se refleja en los
intentos de normativa de la Inteligencia Artificial que han sido publicadas en el Perú.
Por ello, concluiremos que el INDECOPI podría apoyar al consumidor publicando
una Guía de uso de Inteligencia Artificial para el Consumidor.
This article analyzes the presence of Generative Artificial Intelligence under the regulatory framework of Consumer Protection and Defense in Peru. It will be demonstrated that, with the consumer being an always vulnerable presence in the market and our Pro Consumer regulation, this aspect has been left aside in the world of innovative technologies, being vital for the development of something that the Peruvian consumer does not know. Artificial Intelligence has become a tool for commercial and corporate use, with the company that owns its rights being in charge of regulating its use. Clearly, they must know the rules so that they are not penalized when offering their services. On the other hand, the consumer not only does not have technical knowledge of how the tools work, but he is also not in a situation in which he can find out on his own about all the uses and possible infractions that he may incur if he uses Artificial Intelligence in a manner reckless. Therefore, this article, through the analysis of different concepts and sectors of Law in which the use of Artificial Intelligence could be involved, will interpret how a reasonable consumer, this being the highest standard that we can observe in a consumer who is in a situation vulnerable, no matter how hard you try to investigate and learn. Additionally, this is not reflected in the attempts to regulate Artificial Intelligence that have been published in Peru. Therefore, we will conclude that INDECOPI could support the consumer by publishing a Guide to the Use of Artificial Intelligence for the Consumer.
