Redefiniendo la autonomía de los gobiernos descentralizados: posibilidades de intervención del gobierno nacional ante situaciones de crisis

Resumen
La Constitución Política del Perú otorga a los Gobiernos Regionales y Locales autonomía política,
económica y administrativa en los asuntos de su competencia, consagrando así un modelo de
Estado con un Gobierno Unitario y Descentralizado. El ejercicio de dicha autonomía en los
últimos años, sin embargo, no se ha traducido en resultados concretos, servicios efectivos que
atiendan las necesidades ciudadanas, sea por deficiencias e inacciones en la gestión pública
regional y local o por el desborde en actos de corrupción, todo lo cual ha degenerado en lesiones
o peligro inminente de afectación a los derechos y libertades de las personas en los territorios
descentralizados, lo que ha puesto en tela de juicio al proceso de descentralización en el país.
De esta forma, se exige un replanteamiento de lo que significa la autonomía como institución
constitucional, a partir del análisis de su contenido que permita identificar, en primer término,
aquellos presupuestos jurídicos necesarios que se exigen para que un gobierno descentralizado
pueda ejercerla, revalorar los procesos de articulación entre los tres niveles de gobierno, para
que el ejercicio autonómico resulte satisfactorio y, en suma, establecer una mejorada
delimitación y desarrollo normativo de la autonomía constitucional, lo que implica proponer
algunas fórmulas de reforma constitucional y legislativa que justifiquen una intervención
legítima a la autonomía regional y local que, preservándola como institución constitucional,
pueda también atender de manera apropiada los fines y cometidos que dicho ejercicio
autonómico exige.
The Political Constitution of Peru provides Regional and Local Governments, political, economic and administrative autonomy in matters within their jurisdiction, thus establishing a State model with a Unitary and Decentralized Government. However, in recent years, this autonomy has not translated into concrete results and effective services for citizens, whether due to deficiencies and inactions in regional and local public management or due to overflowing acts of corruption, all of which has degenerated into injuries or imminent danger of affecting the rights and freedoms of people in the decentralized territories. This has called into question the decentralization process in the country. In this way, a rethinking of what autonomy means as a constitutional institution is required, based on the analysis of its content that allows us to identify, in the first place, those necessary legal presuppositions that are required for a decentralized government to be able to exercise it, to reassess the processes of articulation between the three levels of government, so that the autonomy function could be satisfactory and, finally, to establish an improved delimitation and normative development of constitutional autonomy, which implies proposing some formulas for constitutional and legislative reform that justify a legitimate intervention in regional and local autonomy that, while preserving it as a constitutional institution, can also appropriate meet the purposes and tasks that such autonomous exercise requires.
