Abstract
El presente trabajo tiene como objetivo principal analizar el reconocimiento del
derecho a la formación profesional en las relaciones laborales en el Perú. Así,
en el primer capítulo se analizará la normativa nacional e internacional de este
derecho, los principios orientadores que rigen el sistema de formación
profesional, según la Organización internacional del Trabajo y su relación con
otros derechos laborales. Asimismo, se analiza el rol prestacional de Estado y
los mecanismos de protección de este derecho.
En el segundo capítulo, se analizará si es posible exigir este derecho en las
relaciones laborales, a fin de determinar cómo funciona el sistema de formación
profesional en el Perú y frente a quienes resulta exigible el derecho. Ello desde
el análisis del marco legal del régimen laboral privado.
En el tercer capítulo, sobre el análisis de los intereses de los actores sociales en
esta materia, se reflexiona sobre los mecanismos de concreción del derecho a
la formación profesional, con especial énfasis en el diálogo social y la
negociación colectiva.
Finalmente, se discute si la formación profesional es un elemento esencial de la
relación laboral y se propone una nueva definición de este derecho frente a los
desafíos actuales que afronta el mercado de trabajo.
The main objective of this paper is to analyze the recognition of the right to vocational training in labor relations in Peru. In the first chapter will analyze the national and international regulations of this right, the guiding principles that govern the vocational training system, according to the International Labor Organization and its relationship with other labor rights. It also analyzes the role of the State in providing benefits and the mechanisms for the protection of this right. In the second chapter, we will analyze whether it is possible to demand this right in labor relations, in order to determine how the vocational training system works in Peru and against whom the right can be demanded. This is based on an analysis of the legal framework of the private labor regime. In the third chapter, on the analysis of the interests of the social actors in this matter, we reflect on the mechanisms of realization of the right to vocational training, with special emphasis on social dialogue and collective bargaining. Finally, it discusses whether vocational training is an essential element of the labor relationship and proposes a new definition of this right in the face of the current challenges facing the labor market.
