Evaluar sin excluir: los ajustes razonables como garantía del derecho a la educación inclusiva en estudiantes con TDAH

Resumen
El artículo pretende subrayar la importancia de reconocer al TDAH como
discapacidad, ello en razón a que los estudiantes con TDAH atraviesan distintas
barreras educativas y sociales que impiden que ejerzan su derecho a la
educación de manera eficaz y en condiciones de igualdad.
Para ello, se determina el marco conceptual y normativo de la discapacidad y las
Necesidades Educativas Especiales (NEE), y se discuten las diferencias en la
categorización de ambos conceptos. Así, se resalta que las NEE y la
discapacidad presentan distinto alcance y por tanto, las implicancias de
encontrarse en alguna de estas categorías, son diferentes.
El TDAH genera diversas limitaciones que, al enfrentarse a las barreras
pedagógicas, institucionales y sociales, puede ser comprendido como una
discapacidad en función del modelo social de discapacidad. Este reconocimiento
fortalece el derecho a la educación inclusiva, la exigibilidad de ajustes razonables
y refuerza la protección contra la discriminación.
Así, el presente artículo propone ampliar el reconocimiento del TDAH como una
discapacidad, dejando de lado la categorización de esta como una NEE no
asociada a discapacidad, a fin de garantizar el derecho a la educación inclusiva,
los ajustes razonables y la igualdad de oportunidades de los estudiantes con
TDAH.
This article aims to underscore the importance of recognizing ADHD as a disability, given that students with ADHD face various educational and social barriers that prevent them from effectively exercising their right to education on an equal footing. To this end, the conceptual and regulatory framework of disability and Special Educational Needs (SEN) is defined, and the differences in the categorization of both concepts are discussed. It is highlighted that SEN and disability have different scopes, and therefore, the implications of falling into one of these categories are different. ADHD generates various limitations which, when faced with pedagogical, institutional, and social barriers, can be understood as a disability according to the social model of disability. This recognition strengthens the right to inclusive education, the enforceability of reasonable accommodations, and reinforces protection against discrimination. Thus, this article proposes to broaden the recognition of ADHD as a disability, moving away from categorizing it as a nondisability- related special educational need, in order to guarantee the right to inclusive education, reasonable adjustments, and equal opportunities for students with ADHD.
