Abstract
Entre los múltiples dilemas que deben resolverse al estructurar un proceso de
justicia transicional, se encuentra la posibilidad de construir políticas que respeten los
estándares de derecho internacional y no representen un obstáculo para que se llegue a un
acuerdo entre las partes en conflicto. El presente artículo plantea que el margen de
apreciación nacional es un mecanismo idóneo para la incorporación de las sentencias de
la Corte Interamericana de Derechos Humanos en el ámbito nacional y, más
concretamente, en procesos de justicia transicional. Para ello, se explicará el margen de
apreciación nacional y su compatibilidad con el control de convencionalidad, las críticas
a la incorporación del margen de apreciación en el contexto americano y la posibilidad de
utilizar el margen de apreciación en contextos de justicia transicional, como mecanismo
idóneo para incorporar y armonizar las decisiones de la Corte Interamericanacon los
procesos de justicia transicional.
Among the multiple dilemmas that must be resolved when structuring a transitional justice process is the possibility of constructing policies that respect the standards of international law and do not represent an obstacle to reaching an agreement between the parties in conflict. This article proposes that the national margin of appreciation is a suitable mechanism for the incorporation of the judgments of the InterAmerican Court of Human Rights at the national level and, more specifically, in transitional justice processes. To this end, the national margin of appreciation and its compatibility with the control of conventionality, the criticisms to the incorporation of the margin of appreciation in the American context and the possibility of using the margin of appreciation in transitional justice contexts will be explained, as a suitable mechanism to incorporate and harmonize the decisions of the Inter-American Court with transitional justice processes.
