El derecho a la asistencia consular: el caso de las personas privadas de la libertad de nacionalidad colombiana en el Perú

Resumen
Existe un derecho exclusivo de las personas extranjeras que se encuentran detenidas
o privadas de la libertad en un país ajeno al suyo. Se denomina el derecho a la
asistencia consular y es derivado del artículo 36 de la Convención de Viena de
Relaciones Consulares de 1963. Se conforma de una serie de derechos individuales
y estatales que incluye: el derecho a la información, a la comunicación, a la
notificación y al acceso efectivo a la asistencia. El garante del derecho es el Estado
receptor, en este caso, el Estado peruano, el cual debe informar sobre este derecho
a los titulares, sin que medie una petición previa.
Este trabajo indaga si el derecho a la asistencia consular es garantizado en Perú,
tanto a las personas privadas de la libertad de nacionalidad colombiana, como al
Consulado General de Colombia en Lima. Esta cuestión es explorada mediante la
identificación de los estándares internacionales de protección a los derechos
humanos de las personas privadas de la libertad en Perú, y el análisis de si estos son
respetados o no. Asimismo, se expone la forma en que se ejerce este derecho en la
praxis, y su relación con la garantía de otros derechos fundamentales.
Por último, se propone un Protocolo para la garantía del derecho a la asistencia
consular a las personas detenidas y privadas de la libertad extranjeras en Perú y a
las representaciones consulares y diplomáticas acreditadas.
There is an exclusive right for foreigners who are detained or deprived of their liberty in a country other than their own. It is the right to consular assistance. It comes from article 36 of the Vienna Convention on Consular Relations of 1963. It is composed by a set of individual and state rights that include: the right to information, communication, notification and effective access to assistance. The guarantor of the right is the receiving State, in this case, the Peruvian State, which must inform to the interested parties about this right, without a prior request. This work investigates whether the right to consular assistance is guaranteed in Peru, both to Colombians deprived of liberty, as well as the Consulate General of Colombia in Lima. This matter is explored by identifying international standards for the protection of the human rights of people deprived of liberty in Peru, and whether these are respected or not. This research exposes the way in which this right is exercised in the field, and its connection with the guarantee of other fundamental rights. Finally, a Protocol is proposed to guarantee the right to consular assistance to foreign detainees and deprived of liberty in Peru and to accredited consular and diplomatic representations.
