Regulación del servicio de transporte de envíos de entrega rápida para el fortalecimiento de la seguridad ciudadana en la Municipalidad Provincial de Ica

Resumen
El presente estudio aborda la regulación del servicio de entrega rápida dentro
del marco del derecho administrativo y la competencia municipal, a partir del
análisis de la Municipalidad Provincial de Ica y el Decreto Supremo N° 006-2025-
MTC. En el primer capítulo, se examinan las competencias municipales en
materia de transporte terrestre y delivery, destacando que, si bien las
municipalidades gozan de autonomía normativa, esta debe ejercerse conforme
a los principios de legalidad, razonabilidad y proporcionalidad. Se evidencia,
además, la ausencia de una ordenanza local específica sobre el servicio de
entrega rápida, lo que genera un vacío normativo frente al marco nacional.
En el segundo capítulo, se analiza la Ordenanza N° 002-2022-MPI y su
insuficiencia ante las nuevas disposiciones del Decreto Supremo N. 006-2025-
MTC. A partir de experiencias de municipios como Miraflores, Surco y San Isidro,
se advierte la necesidad de armonizar la regulación municipal con los
lineamientos nacionales, evitando medidas que puedan devenir en barreras
burocráticas y garantizando, a su vez, la libertad de trabajo y empresa.
Finalmente, el tercer capítulo desarrolla un análisis crítico del citado decreto,
subrayando la importancia de ponderar entre la seguridad ciudadana y los
derechos económicos. Se propone que las futuras ordenanzas municipales
impulsen la formalización y digitalización del servicio de delivery, promoviendo
una gestión eficiente, moderna y respetuosa de los derechos fundamentales.
This study addresses the regulation of express delivery services within the framework of administrative law and municipal jurisdiction, based on an analysis of the Provincial Municipality of Ica and Supreme Decree No. 006-2025-MTC. The first chapter examines municipal powers in the area of land transport and delivery, highlighting that, although municipalities enjoy regulatory autonomy, this must be exercised in accordance with the principles of legality, reasonableness, and proportionality. It also highlights the absence of a specific local ordinance on express delivery services, which creates a regulatory gap in relation to the national framework. The second chapter evaluates Ordinance No. 002-2022-MPI and its inadequacy in light of the new provisions of Supreme Decree No. 006-2025-MTC. Based on the experiences of municipalities such as Miraflores, Surco, and San Isidro, there is a clear need to harmonize municipal regulations with national guidelines, avoiding measures that could become bureaucratic barriers and, at the same time, guaranteeing freedom of work and enterprise. Finally, the third chapter develops a critical analysis of the aforementioned decree, emphasizing the importance of balancing citizen security and economic rights. It is proposed that future municipal ordinances promote the formalization and digitization of delivery services, promoting efficient, modern management that respects fundamental rights.
