La relación entre el Poder Judicial y los jueces y juezas en el inicio de la carrera judicial: reflexiones a partir de entrevistas a un grupo de magistrados y magistradas del área penal

Resumen
Objetivo general
El trabajo de investigación tiene como objetivo general comprender cómo se configura la
relación entre los jueces y juezas penales y el Poder Judicial en la etapa inicial de la
carrera judicial, a partir del análisis del marco normativo y de las experiencias relatadas
por los magistrados entrevistados; si bien ese es el objetivo central, nuestra investigación
nos lleva también, y a partir del análisis empírico, a poner en cuestión el alcance de la
concepción regular de la carrera judicial.
Método empleado
Se empleó un análisis temático-inductivo de entrevistas semiestructuradas, lo que
permitió identificar ejes emergentes vinculados al ingreso a la carrera judicial, las
audiencias de prisión preventiva y la gestión de casos mediáticos.
Principales conclusiones
1.- El concepto de carrera judicial en el Perú está configurado bajo un modelo burocrático
y de control, distante de la concepción garantista y humanista reconocida en los
estándares internacionales.
2.- Los jueces y juezas inician su labor en condiciones de soledad institucional, sin
acompañamiento ni un proceso de inducción que facilite su integración al ejercicio de la
magistratura.
3.- Resulta necesario reconducir la carrera judicial en nuestro país como una política
pública orientada a incorporar dimensiones de bienestar, inclusión y soporte institucional
para jueces y juezas, como condiciones indispensables para el ejercicio independiente y
ético de la función jurisdiccional.
General objective The general objective of this research is to understand how the relationship between criminal judges and the Judicial Branch is configured during the initial stage of the judicial career, through the analysis of the regulatory framework and the experiences narrated by the interviewed magistrates. Although this is the central objective, the empirical findings also lead the study to critically examine the actual scope of the prevailing conception of the judicial career. Method employed A thematic-inductive analysis of semi-structured interviews was applied, which made it possible to identify emerging axes related to entry into the judicial career, pre-trial detention hearings, and the handling of high-profile or media-sensitive cases. Main conclusions 1. The judicial career in Peru is configured under a bureaucratic and control-oriented model, far from the human-rights-based and humanistic conception established in international standards. 2. Judges begin their professional trajectory in conditions of institutional solitude, without induction processes or institutional accompaniment that may facilitate their integration into judicial service. 3. It is necessary to redirect the judicial career in Peru as a public policy aimed at incorporating dimensions of well-being, inclusion and institutional support for judges, as indispensable conditions for the independent and ethically robust exercise of the judicial function.
